Intentionality

Under section 78 of Housing (Wales) Act 2014 the Local Authority is required to confirm the categories that it intends to continue to give regard to when considering intentionality.

 

As a result The Vale of Glamorgan Council confirms that the intentionality test will be applied to all categories contained within the ACT with the exception of the following two categories.

  • Those aged 16 or 17 years of age when the person applies to the Local Housing Authority for accommodation or help in obtaining or retaining accommodation or with whom a person who falls within sub-paragraph (i) resides or might reasonably be expected to reside.

  • Individuals who have attained the age of 18 when the person applies to the Local Housing Authority for accommodation or help in obtaining or retaining accommodation but not the age of 21 who were looked after, accommodated or fostered at any time whilst under the age of 18 or with whom a person who falls within sub-paragraph (i) resides or might reasonably be expected to reside.

Please remember that the Authority has a duty to assess whether you have in any way contributed to your circumstances – this is called ‘intentionality’. Each case is considered carefully to decide whether the loss of accommodation was deliberate or through no fault of your own. ‘
