EARLY RETIREMENT / REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 6th February, 2013.

 

Present: Councillor S.C. Egan (Chairman); Councillors Mrs. P. Drake, P.J. Clarke, H.J.W. James and Mrs. A.J. Moore.

 

 

806     APOLOGY FOR ABSENCE -

 

This was received from Councillor Mrs. M. Kelly Owen.

 

 

807     MINUTES -

 

RESOLVED - T H A T the minutes of the meeting held on 12th December, 2012 be approved as a correct record.

 

 

808     DECLARATIONS OF INTEREST -

 

No declarations were received.

 

 

809     CHAIRMAN’S ANNOUNCEMENT –

 

The Chairman proposed that a training session, in particular on the scheme and its variations, be organised immediately prior to the next meeting.

 

 

810     EXCLUSION OF PRESS AND PUBLIC -

 

RESOLVED - T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.

 

 

811     DETERMINATION OF REDUNDANCY – B. (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (DSS) –

 

Following the development of a new structure and service delivery model for the Vale Community Resource Service (VCRS), B.’s job was formally 'at risk'.  Alternative employment options were being currently considered for B. and it was

 

RESOLVED –

 

(1)       T H A T redundancy terms for B. be approved in accordance with Scheme E of the Council’s Early Retirement / Redundancy Policy and within the financial parameters as recommended in Appendix A to the report subject to Recommendation (2) below.

 

(2)       T H A T, should alternative employment be found for B., the notice period be extended to cover any trial period and revoked together with the redundancy payment should the trial period prove successful.

 

Reasons for decisions

 

(1)       To determine the application for B. in accordance with the Council’s Early Retirement / Redundancy Policy.

 

(2)       To support the implementation of the amendments to the Directorate’s establishment necessary to achieve the financial efficiencies and organisational changes to maintain sustainable service delivery and ensure that the Department’s savings target can be achieved for 2013/14 and future years.

 

 

812     EARLY RETIREMENT APPLICATION – E. (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (DVSH) –

 

Having considered E.’s request and in light of future proposed changes to the structure within Highways and Engineering, it was

RESOLVED – T H A T the application be approved with effect from 28th February, 2013 on the basis of Scheme D – Voluntary Redundancy / Early Retirement with employer’s consent and within the financial parameters as recommended in Appendix A to the report.

 

Reason for decision

 

To determine the application in line with Council policy.

 

 

813     DETERMINATION OF REDUNDANCY – M., C., Sa., K., G., H., Ro., E., Ru., So. AND F. (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (CLSO) –

 

Members were notified that the posts of the above staff were all grant funded and that the Council received notification from the Welsh Government in early March each year as to whether grant funding would be made available to continue to fund the above posts.  Given that there was no certainty that grant funding would continue, notice of redundancy was required to be issued to cover the eventuality that the grant would cease and staff would need to be made redundant.  Authority was, therefore, sought to, should it be required, to allow the Council to give timely notice of redundancy to avoid having to pay salary costs beyond that of the current grant period.  The above members of staff would be placed on the “at risk register†and alternative employment opportunities would be considered.


RESOLVED –

 

(1)       T H A T redundancy be approved for those potentially entitled as set out in the financial schedule appended to the report with effect from 1st April 2013 or such earlier or later date as approved by the Chief Officer and the staff in question on the basis of Scheme E – Termination on the Grounds of Redundancy (subject to Recommendation (2) below and the affected staff complying with the Avoiding Redundancy Procedure).

 

(2)       T H A T, should alternative employment be found for the said employees, the notice be extended to cover any trial period if necessary and Recommendation (1) above revoked together with any redundancy payment should the trial period prove successful. 

 

Reasons for decisions

 

(1)       To support the implementation of the amendments to the Council’s establishment.

 

(2)       To support the Council in achieving the financial efficiencies and organisational changes to maintain sustainable service delivery.

 

 

814     DETERMINATION OF REDUNDANCY – B. (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (CLSO) –

 

B. had been employed by the Pupil Support Service to support a pupil who had now left school.  No suitable alternative employment had been found to date and, as such, B.’s temporary contract needed to be terminated on the grounds of redundancy subject to no redeployment being identified.

 

RESOLVED –

 

(1)       T H A T a redundancy payment be approved with effect from 13th January 2013 on the expiry of notice / payment in lieu or such earlier date as agreed with the Chief Officer and B. on the basis of Scheme E – Termination on the Grounds of Redundancy (subject to Recommendation (2) below and B. complying with the Avoiding Redundancy Procedure).

 

(2)       T H A T, should alternative employment be found for B., the notice be extended to cover any trial period if necessary and Recommendation (1) above be revoked together with the redundancy payment should the trial period prove successful.

 

Reason for decisions

 

(1&2)  To determine the matter in line with Council Policy.
