EARLY RETIREMENT / REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 20th October, 2014.

 

Present:  Councillor S.C. Egan (Chairman); Councillor Mrs. P. Drake (Vice-Chairman) and Councillor Mrs. M. Kelly Owen.

 

 

529     APOLOGIES FOR ABSENCE –

 

These were received from Councillors P.J. Clarke, H.J.W. James and Mrs. A.J. Moore.

 

 

530     MINUTES – 

 

RESOLVED – T H A T the minutes of the meeting held on 22nd September, 2014 be approved as a correct record.

 

 

531     DECLARATIONS OF INTEREST – 

 

No declarations were received.

 

 

532     EXCLUSION OF PRESS AND PUBLIC – 

 

RESOLVED – T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.

 

 

533     DETERMINATION OF AN APPLICATION FOR FLEXIBLE RETIREMENT – H. (DDS) (EXEMPT INFORMATION – PARAGRAPH 12) –

 

Consideration was given to an application for flexible retirement of one officer within the Directorate of Development Services. 

 

RESOLVED –

 

(1)       T H A T the application for flexible retirement be approved and the contract of employment be reduced to three days per week (22 hours) with effect from 1st November, 2014 until 31st January, 2017 with associated savings shown in paragraph 8 of the report. 

 

(2)       T H A T, subject to Resolution (1) above, the approval of the flexible retirement application be subject to no other circumstances arising in the interim whereby the employment of H. may be terminated for a different reason. 

 

(3)       T H A T the use of the appropriate delegated powers be endorsed to secure the necessary changes to the establishment and to reduce the number of contracted hours of H. from 37 to 22 hours per week.

 

Reasons for decisions

 

(1)       To determine the flexible retirement application within the Regulations.

 

(2)       To determine the flexible retirement application within the Regulations and to allow for eventualities which may not be known at this time.

 

(3)       To achieve the necessary changes to the establishment.

 

 

534     DETERMINATION OF REDUNDANCY – S. (DSS) (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) –

 

Consideration was given to the proposed redundancy of one officer within the Directorate of Social Services.

 

RESOLVED –

 

(1)       T H A T the redundancy of the officer be approved with effect from 21st January, 2015 in accordance with Scheme E of the Council’s Early Retirement / Redundancy Policy and a discretionary payment be approved on the grounds of redundancy, subject to the officer complying with the Council’s Avoiding Redundancy Procedure and subject to Resolutions (2) and (3) below.

 

(2)       T H A T, should alternative employment be found for the officer, the notice period be extended to cover any trial period and the date of termination amended to reflect the extension subject to Resolution (3) below.

 

(3)       T H A T, should any trial period prove successful, termination date and redundancy payment be revoked.

 

Reason for decisions

 

(1-3)    To determine the redundancy in line with the Council’s Policy.

 

 

535     DETERMINATION OF REDUNDANCY / EARLY RETIREMENT – J. AND M. (DSS) (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) –

 

Consideration was given to the proposed redundancy of two officers within the Directorate of Social Services.

 

RESOLVED –

 

(1)       T H A T the redundancy in respect of J. be approved with effect from 21st October, 2014 in accordance with Scheme E of the Council’s Early Retirement / Redundancy Policy and a statutory redundancy payment be approved on the grounds of redundancy, subject to the officer complying with the Council’s Avoiding Redundancy Procedure and subject to Resolutions (3) and (4) below.

 

(2)       T H A T the redundancy / early retirement of M. be approved with effect from 21st October, 2014 in accordance with Scheme D and a discretionary payment be approved on the grounds of redundancy / retirement, subject to the officer complying with the Council’s Avoiding Redundancy Procedure and subject to Resolutions (3) and (4) below.

 

(3)       T H A T, should alternative employment be found for both officers, the notice period be extended to cover any trial period and the date of termination be amended to reflect the extension subject to Resolution (4) below.

 

(4)       T H A T, should any trial period prove successful, termination date and redundancy payment be revoked.

 

Reason for decisions

 

(1-4)    To determine the redundancy in line with the Council’s Policy.

 

 

536     DETERMINATION OF APPLICATION FOR REDUNDANCY – M. (DLS) (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) –

 

RESOLVED –

 

(1)       T H A T the redundancy of the officer be approved with effect from 31st October, 2014 in accordance with Scheme D of the Council’s Early Retirement / Redundancy Policy and the statutory payment be approved on the grounds of redundancy, subject to the officer complying with the Council’s Avoiding Redundancy Procedure and subject to Resolutions (2) and (3) below.

 

(2)       T H A T, should alternative employment be found for the officer, the notice period be extended to cover any trial period and the date of termination be amended to reflect the extension subject to Resolution (3) below.

 

(3)       T H A T, should any trial period prove successful, termination date and redundancy payment be revoked.
