EARLY RETIREMENT / REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 12th January, 2015.

 

Present:  Councillor S.C. Egan (Chairman); Councillor Mrs. P. Drake (Vice-Chairman); Councillors: P.J. Clarke, H.J.W. James and Mrs. A.J. Moore.

 

 

772     APOLOGIES FOR ABSENCE –

 

These were received from Councillors Mrs. M. Kelly Owen and C.J. Williams.

 

 

773     MINUTES –

 

RESOLVED – T H A T the minutes of the meeting held on 15th December, 2014 be approved as a correct record.

 

 

774     DECLARATIONS OF INTEREST – 

 

No declarations were received.

 

 

775     EXCLUSION OF PRESS AND PUBLIC –  

 

RESOLVED – T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the schedule being referred to in brackets after the minute heading.

 

 

776     APPLICATION FOR FLEXIBLE RETIREMENT – T. (DLS) (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) –

 

Consideration was given to an application for flexible retirement of one officer within the Directorate of Learning and Skills.

 

RESOLVED –

 

(1)       T H A T the application for flexible retirement be approved and the contract of employment be reduced to three days a week (22 hours) with effect from 9th February 2015 until 8th June 2015 with the associated benefits / costs set out in the report and the supplementary information tabled at the meeting.

 

(2)       T H A T the use of the appropriate delegated powers be endorsed to secure the necessary changes to the establishment and to reduce the number of contracted hours of the individual from 37 to 22 hours per week.

 

(3)       T H A T the Head of Human Resources be requested to remind Directors and Heads of Service that they should have in place appropriate workforce planning and succession planning arrangements with a view to avoiding a similar set of circumstances arising for the Council in the future.

 

Reasons for decisions

 

(1)       To determine flexible retirement application within the Regulations.

 

(2)       To secure the necessary changes to the establishment.

 

(3)       To ensure appropriate workforce planning and succession planning arrangements were in place.

 

 

777     APPLICATION OF AN APPLICATION FOR FLEXIBLE RETIREMENT – B. (HOF) (EXEMPT INFORMATION – PARAGRAPHS 13 AND 14) –

 

Consideration was given to an application for flexible retirement for one officer within the Directorate of Resources. 

 

RESOLVED –

 

(1)       T H A T the application for flexible retirement be approved and the contract of employment be reduced to three days per week (22 hours) with effect from 26th January, 2015 until 31st May, 2015.

 

(2)       T H A T, subject to Resolution (1) above, the approval of the flexible retirement application be subject to no other circumstances arising in the interim whereby the employment of the individual may be terminated for a different reason.

 

(3)       T H A T the use of the appropriate delegated powers be endorsed to secure the necessary changes to the establishment and to reduce the number of contracted hours from 37 to 22 hours per week.

 

Reasons for decisions

 

(1)       To determine the flexible retirement application within the Regulations.

 

(2)       To determine the flexible retirement application within the Regulations and to allow for eventualities which may not be known at this time.

 

(3)       To achieve the necessary change to employee working hours, to assist service continuity and implement appropriate preparations for changes to the structure.

 

 

 

778     DETERMINATION OF APPLICATION FOR REDUNDANCY – C. (HOF) (EXEMPT INFORMATION – PARAGRAPHS 13 AND 14) –

 

Consideration was given to an application for redundancy in respect of one officer within the Directorate of Resources.

 

RESOLVED –

 

(1)       T H A T the redundancy of the officer be approved with effect from 1st April 2015 in accordance with Scheme E of the Council’s Early Retirement / Redundancy Policy with the Council accepting the Welsh Government’s offer to fund a statutory payment in respect of the individual and accordingly a statutory payment be approved on the grounds of redundancy subject to the officer complying with the Council’s Avoiding Redundancy Procedure and subject to Resolutions (2) and (3) below.

 

(2)       T H A T, should alternative employment be found for the officer, the notice period be extended to cover any trial period and the date of termination be amended to reflect the extension, subject to Resolution (3) below.

 

(3)       T H A T, should any trial period prove successful, the termination date and redundancy payment be revoked.

 

(4)       T H A T the Head of Finance enter into discussions with the Welsh Government regarding the funding of a discretionary redundancy payment in respect of the individual and, dependent on the outcome of those discussions, the Head of Finance be requested to submit a further report to the Committee for consideration.

 

Reasons for decisions

 

(1-3)    To determine the redundancy in line with the Council’s Policy.

 

(4)       To determine whether the Welsh Government was prepared to fund a discretionary redundancy payment.

 

 

779     DETERMINATION OF VOLUNTARY EARLY RETIREMENT ON THE GROUNDS OF REDUNDANCY – G. (DR) (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) –

 

Consideration was given to the proposed redundancy of one officer within the Directorate of Resources.

 

RESOLVED –

 

(1)       T H A T the redundancy in respect of G. be approved with effect from 31st January 2015, in accordance with Scheme D of the Council’s Early Retirement / Redundancy Policy and a discretionary redundancy payment be approved on the grounds of redundancy, subject to the officer complying with the Council’s Avoiding Redundancy Procedure and subject to Resolutions (2) and (3) below.

 

(2)       T H A T, should alternative employment be found for the officer, the notice period be extended to cover any trial period and the date of termination be amended to reflect the extension, subject to Resolution (3) below.

 

(3)       T H A T, should any trial period prove successful, the termination date and redundancy payment be revoked.
