 EARLY RETIREMENT/REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 9th February, 2015.

 

Present:  Councillor S.C. Egan (Chairman); Councillor Mrs. P. Drake (Vice-Chairman); Councillors P.J. Clarke, Mrs. M. Kelly Owen, Mrs. A.J. Moore and C.J. Williams.

 

 

847     APOLOGY FOR ABSENCE -

 

This was received from Councillor H.J.W. James.

 

 

848     MINUTES -

 

RESOLVED - T H A T the minutes of the meeting held on 12th January, 2015 be approved as a correct record.

 

 

849     DECLARATIONS OF INTEREST -

 

No declarations were received.

 

 

850     EXCLUSION OF PRESS AND PUBLIC -

 

RESOLVED - T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.

 

 

851     DETERMINATION OF APPLICATION FOR REDUNDANCY - C - UPDATE - (HOF) (EXEMPT INFORMATION - PARAGRAPHS 13 AND 14) - 

 

At the last meeting, redundancy of the officer concerned had been approved with effect from 1st April, 2015, with the Council accepting the Welsh Government’s offer to fund a statutory payment in respect of the individual.  It had been further resolved that the Head of Finance enter into discussions with the Welsh Government regarding the funding of a discretionary redundancy payment. 

 

Confirmation had now been received that Welsh Government would agree to reimburse the costs of a discretionary payment, it being noted that redeployment opportunities would continue to be pursued through the Council’s Redeployment Policy.  

 

RESOLVED -

 

(1)       T H A T C be paid the discretionary redundancy amount as set out within Appendix A to the report.

 

(2)       T H A T should alternative employment be found for C, notice will be extended to cover any trial period and if that trial period proves a success and C accepts the alternative position recommendation (1) above will be revoked, together with the redundancy payment.

 

Reasons for decisions

 

(1)       To determine the redundancy payment for the employee in accordance with the Council's Redundancy Policy and the amount reclaimable from Welsh Government. 

 

(2)       The Council’s redeployment procedures are being applied currently.  If C is successful in finding alternative employment during  this time, and providing the trial period is successful the individual will be retained in the redeployment role and as such there will be no need for the redundancy to take effect and so no redundancy payment will be due.

 

 

852     APPLICATION FOR FLEXIBLE RETIREMENT - B (MD) (EXEMPT INFORMATION - PARAGRAPHS 13 AND 14) -

 

Consideration was given to an application for flexible retirement of one officer within the Management Directorate. 

 

RESOLVED -

 

(1)       T H A T the flexible retirement of B be agreed in accordance with the Council's policy.

 

(2)       T H A T the use of the appropriate delegated powers be endorsed, to enable B to reduce contracted hours from 37 to 15 hours per week from the week commencing 2nd March 2015.

 

(3)       T H A T the retirement of B from employment with the Council take place on or before 31st July 2015. 

 

Reasons for decisions

 

(1)       To determine the flexible retirement application within the regulations.

 

(2&3)  To achieve the necessary change to the employee's working hours, to assist service continuity and implement appropriate preparations for changes to the structure.

 

 

853     DETERMINATION OF APPLICATION OF REDUNDANCY - T (DVSH) (EXEMPT INFORMATION - PARAGRAPHS 13 AND 14) -

 

Consideration was given to an application for statutory redundancy in respect of one officer within the Visible Service and Housing Directorate.

 

RESOLVED -

 

(1)       T H A T Members of the Committee agree to the redundancy of T in accordance with the recommended benefits as set out within Appendix A to the report.

 

(2)       T H A T should suitable alternative employment be found for T, notice will be extended to cover any trial period, and if that trial period proves a success and T accepts the alternative position, recommendation (1) above will be revoked, together with the redundancy payment.

 

Reasons for decisions

 

(1)       To determine the redundancy for the employee in accordance with the contract of employment. 

 

(2)       The Council’s redeployment procedures are being applied currently.  If T is successful in finding alternative employment in this time, and providing the trial period is successful the individual will be retained in the redeployment role and as such there will be no need for the redundancy to take effect and so no redundancy payment will be due.

 

 

854     DETERMINATION OF VOLUNTARY EARLY RETIREMENT ON THE GROUNDS OF REDUNDANCY - G, M AND P (DVSH) (EXEMPT INFORMATION - PARAGRAPHS 13 AND 14) -

 

Consideration was given to applications for voluntary early retirement on the grounds of redundancy in respect of three officers within the Visible Services and Housing Directorate.

 

RESOLVED -

 

(1)       T H A T redundancy be approved in respect of G, M and P with effect from 31st March 2015 on the basis of Scheme D – Voluntary Early Retirement on the Grounds of Redundancy (discretionary scheme), subject to recommendation (2) below.

 

(2)       T H A T should suitable alternative employment be available for any of the employees, notice will be extended to cover any trial period, and if that trial period proves a success and an employee (s) accepts the alternative position recommendation (1) above will be revoked, together with the redundancy payment. 

 

Reasons for decisions

 

(1)       To determine the option for G, M and P in accordance with the Council's Early Retirement/Redundancy/Termination policy.

 

(2)       The Council’s redeployment procedures are being applied currently.  If any of the employees are successful in finding suitable alternative employment prior to the 31st March 2015, and providing the trial period is successful the individual(s) will be retained in the redeployment role and as such there will be no need for the redundancy to take effect and so no redundancy payment (s) will be due.
