EARLY RETIREMENT/REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 23rd March, 2015.

 

Present:  Councillor S.C. Egan (Chairman); Councillor Mrs. P. Drake (Vice-Chairman); Councillors P.J. Clarke, H.J.W. James, Mrs. M. Kelly Owen, Mrs. A.J. Moore and C.J. Williams.

 

 

1038   MINUTES -

 

RESOLVED - T H A T the minutes of the meeting held on 9th February, 2015 be approved as a correct record.

 

 

1039   DECLARATIONS OF INTEREST -

 

No declarations were received.

 

 

1040   EXCLUSION OF PRESS AND PUBLIC -

 

RESOLVED - T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.

 

 

1041   DETERMINATION OF VOLUNTARY EARLY RETIREMENT ON THE GROUNDS OF REDUNDANCY - B (DDS) (EXEMPT INFORMATION - PARAGRAPHS 13 AND 14) -

 

Consideration was given to an application for Voluntary Early Retirement on the grounds of redundancy in respect of one officer within the Development Services Directorate.

 

RESOLVED -

 

(1)       T H A T redundancy be approved in respect of B with effect from 31st March 2015 on the basis of Scheme D - Voluntary Retirement on the Grounds of Redundancy (discretionary scheme).

 

(2)       T H A T should suitable alternative employment be available for B, notice will be extended to cover any trial period.  If a trial period proves to be successful and the employee accepts the alternative position, recommendation (1) above will be revoked, together with the redundancy payment.


Reasons for decision

 

(1)       To determine the option for B in accordance with the Council's Early Retirement/Redundancy/Termination policy.

 

(2)       The Council's redeployment procedures are being applied currently.  If the employee is successful in finding suitable alternative employment prior to the 31st March 2015, and providing the trial period is successful the individual will be retained in the redeployment role and as such there will be no need for the redundancy to take effect and so no redundancy payment will be due.

 

 

1042   DETERMINATION OF VOLUNTARY EARLY RETIREMENT ON THE GROUNDS OF REDUNDANCY - O (DDS) (EXEMPT INFORMATION - PARAGRAPHS 13 AND 14) -

 

Consideration was given to an application for Voluntary Early Retirement on the grounds of redundancy in respect of one officer within the Development Services Directorate.

1044   DETERMINATION OF REDUNDANCY - C, S, AND R (DLS) (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) -

 

Consideration was given to the ending of temporary employment, and potential redundancy payments, in respect three officers within the Learning and Skills Directorate as a result of the ending of Welsh Government funding. 

 

RESOLVED -

 

(1)       T H A T the Committee approve the end of temporary contracts for C and S on 23rd June 2015 and R on 31st  August 2015 on the basis that funding for the Learning Programme has been withdrawn by Welsh Government.

 

(2)       T H A T, on the basis of length of service, a redundancy payment be approved with effect from 23rd June 2015 for C and S or such earlier date as recommended by the Director of Learning and Skills on the basis of Scheme E - termination grounds of redundancy, and on the basis that staff have over two years' service.

 

(3)       T H A T on the basis of length of service, a redundancy payment be approved for R with effect from 31st August 2015.  R is employed on Teaching terms and conditions and as a result will need to be paid up to this date.

 

(4)       T H A T should alternative employment be found for C, S, R, the notice be extended to cover any trial period if necessary and recommendation (1) above be revoked, together with the redundancy payment should the trial period prove successful.

 

Reasons for decisions

 

(1)       To ensure that the costs associated with the Adult Community Learning Service are contained within available grant funding.

 

(2)       To ensure the Council complies with relevant employment legislation in paying, where applicable, an appropriate redundancy payment to staff based on length of service.

 

(3)       To support the Council in maintaining sustainable service delivery.

 

(4)       To maintain compliance with the Council's agreed Management of Change policy and procedures.

 

 

1045   DETERMINATION OF REDUNDANCY - C, S, P, Ri AND Rii (DLS) (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) -

 

Consideration was given to proposed redundancy in respect of five officers within the Learning and Skills Directorate. 

 

RESOLVED -

 

(1)       T H A T Committee approve the termination of employment of C, S, P and Ri on 23rd June 2015 on the basis that they were unsuccessful in securing a post in the reduced staffing structure or an appropriate redeployment post and no alternative funding has been secured.

 

(2)       T H A T Committee approve the termination of Rii on 3rd May 2015 due to reduced staffing structure and no alternative funding being secured.

 

(3)       T H A T on the basis of length of service, a redundancy payment be approved with effect from 23rd June 2015 or such earlier date as determined by the Director of Learning and Skills on the basis of Scheme E - termination on the grounds of redundancy, and on the basis that all staff have over two years’ service.  Ri to be considered on the basis of Scheme D Early Retirement/Redundancy.

 

(4)       T H A T should alternative employment be found for C, S, P, Ri and Rii, the notice be extended to cover any trial period if necessary and recommendation (1)  and (2) above be revoked, together with the redundancy payment should the trial period prove successful.

 

Reasons for decisions

 

(1)       To ensure that the costs associated with the Adult Community Learning (ACL) Programme are contained within available grant funding.

 

(2&3)  To ensure the Council complies with relevant employment legislation in paying, where applicable, an appropriate redundancy payment to staff based on length of service.

 

(4)       To support the Council in maintaining sustainable service delivery.

 

 

1046   DETERMINATION OF APPLICATION FOR REDUNDANCY - S (DVSH) (EXEMPT INFORMATION - PARAGRAPHS 13 AND 14) -

 

Consideration was given to an application for voluntary redundancy in respect of one officer within the Visible Services and Housing Directorate.

 

RESOLVED -

 

(1)       T H A T redundancy be approved in respect of S with effect from 31st March, 2015, on the basis of Scheme E - Redundancy.

 

(2)       T H A T should suitable alternative employment be found for S, notice will be extended to cover any trial period.  Should that trial period prove to be successful and S accepts the alternative position, recommendation (1) above will be revoked, together with the redundancy payment.

 

Reasons for decisions

 

(1)       To determine the redundancy of the employee in accordance with the Council's approved Early Retirement / Redundancy Policy.

 

(2)       The Council's redeployment procedures are being applied currently.  If S is successful in finding alternative employment in this time, and providing the trial period is successful the individual will be retained in the redeployment role and as such there will be no need for the redundancy to take effect and so no redundancy payment will be due.
