EARLY RETIREMENT/REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 21st March, 2016.

 

Present:  Councillor S.C. Egan (Chairman); Councillor Mrs. P. Drake (Vice-Chairman); Councillors G. John, Mrs. M. Kelly Owen and Mrs. A. Moore.

 

 

953     APOLOGIES FOR ABSENCE -

 

These were received from Councillors P.J. Clarke and H.J.W. James.

 

 

954     MINUTES -

 

RESOLVED - T H A T the minutes of the meeting held on 29th February, 2016 be approved as a correct record.

 

 

955     DECLARATIONS OF INTEREST -

 

No declarations were received.

 

 

956     EXCLUSION OF PRESS AND PUBLIC -

 

RESOLVED - T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.

 

 

957     DETERMINATION OF REDUNDANCY - B (DSS) (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) -

 

Consideration was given to an application for redundancy in respect of one officer within the Directorate of Social Services.

 

RESOLVED -

 

(1)       T H A T the statutory redundancy payment be approved with effect from 6th April, 2016 on the basis of termination on grounds of redundancy under Scheme E subject to Resolution (2) below and in accordance with the financial parameters set out within Appendix B of the report.

 

(2)       T H A T should suitable alternative employment be found for B, the notice be extended to cover any trial period, and if that trial period proves a success Resolution (1) above be revoked, together with the redundancy payment.

 

Reasons for decisions

 

(1)       To determine the redundancy for the employee in accordance with the Council’s Early Retirement/Redundancy/Termination Policy.

 

(2)       To maintain compliance with employment legislation.

 

 

958     DETERMINATION OF REDUNDANCY - D (DSS) (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) -

 

Consideration was given to an application for redundancy in respect of one officer within the Directorate of Social Services. 

 

RESOLVED -

 

(1)       T H A T the statutory redundancy payment be approved with effect from 22nd June, 2016 on the basis of termination on the grounds of redundancy under Scheme E and in accordance with Appendix B to the report and subject to Resolution (2) below.

 

(2)       T H A T should alternative employment be found for D, the notice would be extended to cover any trial period and if that trial period proved successful, Resolution (1) above be revoked together with the redundancy payment.

 

Reasons for decisions

 

(1)       To determine the redundancy for the employee in accordance with the Council’s Early Retirement/Redundancy/Termination Policy.

 

(2)       To maintain compliance with employment legislation.

 

 

959     APPLICATION FOR FLEXIBLE RETIREMENT - D (MD) (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) -

 

Consideration was given to an application for flexible retirement to support the transition to permanent retirement more effectively which was considered to be in the best interests of the employee and the Council.

 

RESOLVED -

 

(1)       T H A T the flexible retirement in respect of D be approved in accordance with the Council’s Policy subject to no other circumstances arising in the interim whereby the employment would be terminated for a different reason.

 

(2)       T H A T the use of the appropriate delegated powers be endorsed, to enable D to reduce their contracted hours from 37 to 22 hours per week from week commencing 4th April, 2016 and that the retirement of D from the employment of the Council to take place on or before 2nd October, 2016.

 

Reasons for decisions

 

(1)       To determine the flexible retirement application within the regulations and to allow for eventualities that may not be known at this time.

 

(2)       To achieve the necessary change to the employees working hours, to assist service continuity, provide appropriate support to assist the employee’s transition to retirement and to contribute to the savings of the service.

 

 

960     DETERMINATION OF REDUNDANCY/EARLY RETIREMENT - M (MD) (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) -

 

Consideration was given to the proposed redundancy of the above employee as a result of proposed restructuring proposals within the Resources Directorate.

 

RESOLVED -

 

(1)       T H A T the redundancy be approved in respect of M with effect from 22nd June, 2016 on the basis of Scheme D of the Council’s Statutory Redundancy Policy and within the financial parameters set out in Appendix A to the report and subject to Resolution (2) below.

 

(2)       T H A T should alternative employment be found for M the notice be extended to cover any trial period, and if that trial period proves a success, Resolution (1) above be revoked, together with the redundancy payment.

 

Reasons for decisions

 

(1)       To support the Council in achieving the financial efficiencies and organisational changes necessary to maintain sustainable service delivery.

 

(2)       To maintain compliance with employment legislation and with relevant Council policy and procedures.

 

 

961     DETERMINATION OF VOLUNTARY RETIREMENT ON THE GROUNDS OF REDUNDANCY - W (MD) (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) -

 

Consideration was given to an application for voluntary early retirement on the grounds of redundancy in respect of W within the Resources Directorate.

 

RESOLVED -

 

(1)       T H A T the redundancy be approved in respect of W with effect from 31st March, 2016 on the basis of Scheme D, voluntary early retirement on the grounds of redundancy (Discretionary Scheme) subject to Resolution (2) below.

 

(2)       T H A T should alternative employment be available for W, the notice would be extended to cover any trial period and if that trial period proved a success, Resolution (1) above be revoked, together with the redundancy payment.

 

Reasons for decisions

 

(1)       To determine the option for W in accordance with the Council’s Early Retirement/Redundancy/Termination Policy. 

 

(2)       The Council’s re-deployment procedures were being applied.  If the employee was successful if finding suitable alternative employment prior to 31st March, 2016, and providing the trial period is a success, the individual would be retained in a redeployment role and as such there would be no need for the redundancy to take effect and so no redundancy payment would be due.
