EARLY RETIREMENT/REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 27th June, 2016.

 

Present:  Councillor S.C. Egan (Chairman); Councillor Ms. B.E. Brooks (Vice-Chairman); Councillors G. John, H.J.W. James, Mrs. M. Kelly Owen and Mrs. A. Moore.

 

 

115     MINUTES -

 

RESOLVED - T H A T the minutes of the meeting held on 6th June, 2016 be approved as a correct record.

 

 

116     DECLARATIONS OF INTEREST -

 

No declarations were received.

 

 

117     EXCLUSION OF PRESS AND PUBLIC -

 

RESOLVED - T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.

 

 

118     DETERMINATION OF REDUNDANCY - T (DLS) (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) -

 

Consideration was given to the proposed redundancy in respect of one officer within the Directorate of Learning and Skills.

 

RESOLVED -

 

(1)       T H A T a discretionary redundancy payment be approved in respect of T with effect from 31st August, 2016 on the basis of termination on the grounds of redundancy under Scheme E of the Council’s Scheme subject to Resolution (2) below and in accordance with the financial parameters as set out in the Appendix to the report.

 

(2)       T H A T should suitable alternative employment be found for T, the notice be extended to cover any trial period, and if that trial period proves a success, Resolution (1) be revoked together with the redundancy payment.


 

Reasons for decisions

 

(1)       To support the implementation of the amendment to the Council’s establishment.

 

(2)       To support the Council in achieving the financial efficiencies and organisational changes to maintain sustainable service delivery.

 

 

119     DETERMINATION OF REDUNDANCY/EARLY RETIREMENT - P (DLS) (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) -

 

Consideration was given to the proposed early retirement on the grounds of redundancy of one officer within the Learning and Skills Directorate.

 

RESOLVED -

 

(1)       T H A T a statutory redundancy payment in respect of P be endorsed on the basis of Scheme D of the Council’s Discretionary Redundancy Policy as set out in Appendix A to the report and within the financial parameters set out in Appendix B to the report and the employee complying with the Avoiding Redundancy Procedure.

 

(2)       T H A T subject to Resolution (1) above, and in recognition of the decision of Cabinet on 20th June, 2016 in respect of the management review of the Directorate of Learning and Skills that the application of P and the recommendations of this Committee be forwarded to Full Council for final determination on 20th July, 2016.

 

(3)       T H A T should suitable alternative employment be found for P, the notice be extended to cover any trial period, and if that trial period proves a success, Resolutions (1) and (2) be revoked together with the redundancy payment.

 

Reasons for decisions

 

(1&3)  To support the Council in achieving the financial efficiencies and organisational changes necessary to maintain sustainable service delivery.

 

(2)       To ensure compliance with the Council’s Employee Pay Policy 2016/17 and guidance issued by Welsh Government under Section 40 of the Localism Act 2011.

 

 

120     DETERMINATION OF REDUNDANCY - W (DEH) (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) -

 

Consideration was given to an application for redundancy in respect of one officer within the Directorate of Environment and Housing.

 

RESOLVED -

 

(1)       T H A T a statutory redundancy payment be approved in respect of W with effect from 31st August, 2016 on the basis of Scheme E of the Council’s Scheme subject to Resolution (2) below and in accordance with the financial parameters set out in Appendix A to the report and the employee complying with the Avoiding Redundancy Procedure.

 

(2)       T H A T should suitable alternative employment be found for W, the notice be extended to cover any trial period, and if that period proves a success, Resolution (1) be revoked, together with the redundancy payment.

 

Reasons for decisions

 

(1)       To support the implementation of the amendment to the Council’s establishment.

 

(2)       To support the Council in achieving the financial efficiencies and organisational changes to maintain sustainable service delivery.

 

 

121     APPLICATION FOR FLEXIBLE RETIREMENT - B (DEH) (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) -

 

Consideration was given to an application for flexible retirement for one officer within the Environment and Housing Services Directorate.

 

(1)       T H A T the application for flexible retirement of B be approved and the contract of employment be reduced to 3 days per week (22 hours) with effect from 11th July, 2016 until on or before 10th January, 2018 in accordance with the Council’s policy subject to no other circumstances arising in the interim whereby the employment were to be terminated for a different reason.

 

(2)       T H A T the use of the appropriate delegated powers be endorsed to secure the necessary changes to the establishment and to reduce the number of contracted hours of the individual from 37 to 22 hours per week.

 

Reasons for decisions

 

(1)       To determine the flexible retirement within the Regulations and to allow for eventualities that may not be known at this time.

 

(2)       To achieve the necessary changes to the contracted working hours of B, to assist service continuity, to provide appropriate support to assist the employee’s transition to retirement and to contribute to the savings of the service or other reasons (including to support training preparations).
