EARLY RETIREMENT/REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 28th November, 2016.

555     MINUTES –

 

RESOLVED – T H A T the minutes of the meeting held on 17th October, 2016 be approved as a correct record.

 

 

556     DECLARATIONS OF INTEREST –

 

No declarations were received.

 

 

557     EXCLUSION OF PRESS AND PUBLIC –

 

RESOLVED – T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.

 

 

558     DETERMINATION OF REDUNDANCY – A, P, B, E, D, M, T AND J (EXEMPT INFORMATION – PARAGRAPHS 12 AND 14) (MD) –

 

Consideration was given to applications for redundancy in respect of the above employees within the Managing Director and Resources Directorate.

 

RESOLVED –

 

(1)       T H A T a statutory redundancy payment is approved for  A, P, B, E, D, M, T and J, under scheme E of the Council's Early Retirement/Redundancy Policy on the basis of termination on the grounds of redundancy as of 31st March, 2017, subject to Recommendation (2).

 

(2)       T H A T notices of termination of employment be extended in the event that funding is forthcoming and in anticipation of the likelihood of a restructure of the team and, if necessary, Recommendation (1) be revoked, together with the redundancy payment for any employee successful in securing employment through that restructure or through redeployment.

 

Reasons for decisions

 

(1)       To support the cessation of delivery of the service as a result of grant funding no longer being available.

 

(2)       To comply with the terms of the Council's Avoiding Redundancy Policy.

 

 

559     DETERMINATION OF VOLUNTARY EARLY RETIREMENT ON THE GROUNDS OF REDUNDANCY – J (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (MD) –

 

Consideration was given to one application for early retirement / redundancy in respect of one employee within the Managing Director and Resources Directorate.

 

RESOLVED –

 

(1)       T H A T the redundancy / early retirement of J be approved with effect from 31st December, 2016 on the basis of Scheme D – Voluntary Retirement on the Grounds of Redundancy (discretionary scheme).

 

(2)       T H A T, should alternative employment be found for J, the notice be extended to cover any trial period if necessary and Recommendation (1) be revoked, together with the redundancy payment should the trial period prove successful.

 

Reasons for decisions

 

(1)       To determine the option for J in accordance with the Council's Early Retirement / Redundancy / Termination policy.

 

(2)       To support the Council in achieving the financial efficiencies and organisational changes to maintain sustainable service delivery.

 

 

560     APPLICATION FOR FLEXIBLE RETIREMENT – S (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (MD) –

 

Consideration was given to an application for flexible retirement in respect of one employee within the Managing Director and Resources Directorate.

 

RESOLVED –

 

(1)       That the flexible retirement of S in accordance with the Council's policy, subject to no other circumstances arising in the interim whereby the employment were to be terminated for a different reason, be agreed.

 

(2)       T H A T the use of the appropriate delegated powers be endorsed, to enable S to reduce their contracted hours from 37 to 22 hours per week from the week commencing 6th February, 2017.

 

(3)       T H A T the retirement of S from employment with the Council take place on or before 30th July, 2017.

 

Reasons for decisions

 

(1)       To determine the flexible retirement application within the regulations and to allow for eventualities that may not be known at this time.

 

(2&3)  To achieve the necessary change to the employee's working hours, to assist service continuity, provide appropriate support to assist the employee's transition to retirement and to contribute to the savings of the Service.

 

           

561     DETERMINATION OF REDUNDANCY – C, Sa, T, G, Sm, R AND D (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (IDLS) –

 

Consideration was given to applications for redundancy in respect of the above employees within the Learning and Skills Directorate.

 

RESOLVED –

 

(1)       T H A T, subject to ongoing consultation with staff and Trade Unions, a statutory redundancy payment be approved for those potentially entitled as set out in the financial schedule with effect from 31st March, 2017 or such earlier or later date as agreed by the Chief Officer  for  C, Sa, T, G, Sm R and D on the basis of Scheme E – termination on the grounds of redundancy, subject to Recommendations (2) or (3) (as appropriate) and to the employees complying with the avoiding redundancy procedure and associated provisions.

 

(2)       T H A T, should adequate grant funding be made available by Welsh Government for these posts to continue, then the notice be withdrawn and the redundancy payment in Recommendation (1) be revoked.

 

(3)       T H A T, should alternative employment be found for C, Sa, T, G, Sm R and D, the notice be extended to cover any trial period if necessary and Recommendation (1) be revoked together with the redundancy payment should the trial period prove successful.

 

Reasons for decisions

 

(1)       To ensure that the costs associated with the Ethnic Minority Achievement Service are contained within available grant funding.

 

(2)       In the event that further grant funding of a sufficient level is forthcoming from Welsh Government, then these posts could be continued with and there would be no redundancy situation arising.

 

(3)       The individuals would no longer be at risk of redundancy in this eventuality and therefore would not be entitled to a redundancy payment.

 

 

562     DETERMINATION OF REDUNDANCY – E (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (IDLS) –

 

Consideration was given to an application for redundancy in respect of one employee within the Learning and Skills Directorate. 

 

RESOLVED –

 

(1)       T H A T a redundancy payment be approved with effect from 31st March, 2017 on the basis of Scheme D of the Council’s Early Retirement / Redundancy schemes – termination on grounds of early retirement / redundancy (subject to Recommendation (2) and E complying with the avoiding redundancy procedure).

 

(2)       T H A T, should alternative employment be found for E, the notice be extended to cover any trial period if necessary and Recommendation (1) be revoked together with the redundancy payment should the trial period prove successful.

 

Reasons for decisions

 

(1)       To support the implementation of the amendments to the Council's establishment.

 

(2)       To support the Council in achieving the financial efficiencies and organisational changes to maintain sustainable service delivery.

 

 

563     DETERMINATION OF REDUNDANCY – P (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (HHR) –

 

Consideration was given to an application for redundancy in respect of one employee within the Managing Director and Resources Directorate.

 

RESOLVED –

 

(1)       T H A T a redundancy payment be approved with effect from 30th June, 2017 or such earlier date as agreed by the Head of Human Resources and P, on the basis of Scheme E of the Council’s scheme – termination on grounds of redundancy (subject to Recommendation (2) and P complying with the avoiding redundancy procedure).

 

(2)       T H A T, should alternative employment be found for P, the notice be extended to cover any trial period if necessary and Recommendation (1) be revoked together with the redundancy payment should the trial period prove successful

 

Reasons for decisions

 

(1)       To support the implementation of the amendments to the Council's establishment.

 

(2)       To support the Council in achieving the financial efficiencies and organisational changes to maintain sustainable service delivery.

 

 

564     DETERMINATION OF REDUNDANCY – B (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (HHR) –

 

Consideration was given to an application for redundancy in respect of one employee within the Managing Director and Resources Directorate.

 

RESOLVED –

 

(1)       T H A T the application be approved on the basis of Scheme E of the Council’s Discretionary Redundancy policy and within the financial parameters as set out in Appendices A and B of the report and subject to recommendations as set out below.

 

(2)       T H A T the application be approved in the context of the restructuring in January 2016 as alluded to in the report and in anticipation of the ending of B’s subsequent and temporary secondment.

 

(3)       T H A T the application be approved, but only in the circumstances where:

  • An offer of suitable alternative employment is not made to the postholder by the Council during the life of the postholder’s current secondment period; and
  • The postholder is not offered and does not accept employment by any organisation covered by the Redundancy Payment (Continuity of Employment in Local Government etc.) (Modification) Order 1999 prior to the end of (or within four weeks of the end of) the secondment period.

(4)       T H A T, subject to the above conditions, the application be approved and take effect either on 31st December, 2017 (the maximum period of the secondment) or at any earlier point if the secondment ends prematurely.

 

(5)       T H A T in any of the circumstances as set out in (3) above, B’s application will be withdrawn and the eligibility to be paid a redundancy payment will no longer apply.

 

Reasons for decisions

 

(1-5)    To support the Council in achieving the financial efficiencies and organisational changes necessary to maintain sustainable service delivery.

 

 

565     APPLICATION FOR FLEXIBLE RETIREMENT – J (EXEMPT INFORMATION – PARAGRAPHS 13 AND 14) (HHR) –

 

Consideration was given to an application for flexible retirement in respect of one employee within the Managing Director and Resources Directorate.

 

RESOLVED –

 

(1)       T H A T the flexible retirement of J in accordance with the Council's policy be agreed, subject to no other circumstances arising in the interim whereby the employment would be terminated for a different reason.

 

(2)       T H A T the use of the appropriate delegated powers be endorsed to enable J to reduce J's contracted hours from 37 to 22 hours per week from the week commencing 9th January, 2017.

 

(3)       T H A T the retirement of J from employment with the Council take place on or before 31st March, 2018.

(1)       To determine the flexible retirement application of J within the regulations and to allow for eventualities that may not be known at this time.
