EARLY RETIREMENT/REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 19th March, 2018.

 

Present:  Councillor Mrs. R. Nugent-Finn (Chairman); Councillors Mrs. P. Drake, S.T. Edwards, G. John and N.C. Thomas.

 

 

786     APOLOGIES FOR ABSENCE –

 

This was received from Councillor Mrs. A. Moore.

 

 

787     MINUTES –

 

RESOLVED – T H A T the minutes of the meeting held on 19th February, 2018 be approved as a correct record.

 

 

788     DECLARATIONS OF INTEREST –

 

No declarations were received.

 

 

789     EXCLUSION OF PRESS AND PUBLIC –

 

RESOLVED – T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.

 

 

790     DETERMINATION OF REDUNDANCY – L (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (MD) –

 

Consideration was given to an application for redundancy within the Directorate of Environment and Housing.

 

RESOLVED –

 

(1)       T H A T a discretionary redundancy payment be approved with effect from 31st March, 2018 on the basis of Scheme E of the Council’s Early Retirement / Redundancy Scheme and within the financial parameters set out in Appendix A to the report, subject to the individual complying with the Council’s Avoiding Redundancy Procedure and subject to Resolution (2) below.

 

(2)       T H A T should alternative employment be found for L then Resolution (1) above be revoked, together with the redundancy payment.

 

Reasons for decisions

 

(1)       To ensure compliance with the Council’s policy requirements in relation to the ending of a fixed term employment contract.

 

(2)       To support the Council in achieving the financial efficiencies and organisational changes to maintain suitable service delivery.

 

 

791     DETERMINATION OF REDUNDANCY – C (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (MD) –

 

Consideration was given to an application for a proposed redundancy in respect of C within the Managing Director and Resources Directorate.

 

RESOLVED –

 

(1)       T H A T a statutory redundancy payment be approved with effect from 30th April, 2018 on the basis of Scheme D of the Council’s Early Retirement / Redundancy Scheme and within the financial parameters set out within Appendix A to the report, subject to Resolution (2) below and the individual complying with the Council’s Avoiding Redundancy Procedures.

 

(2)       T H A T should alternative employment be found for C the notice be extended to cover any trial period if necessary and that Resolution (1) above be revoked, together with the redundancy payment should the trial period prove successful.

 

Reasons for decisions

 

(1)       To support the implementation of the amendments of the Council’s establishment.

 

(2)       To support the Council in achieving the financial efficiencies and organisational changes to maintain sustainable service delivery.

 

 

792     APPLICATION FOR EXTENSION OF FLEXIBLE RETIREMENT – J (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (MD) –

 

Consideration was given to an application to extend the flexible retirement period in respect of the above employee within the Managing Director and Resources Directorate.

 

RESOLVED –

 

(1)       T H A T the extension of the flexible retirement period of J be approved in accordance with the Council’s Policy subject to no other circumstances arising in the interim whereby the employment were to be terminated for a different reason.

(2)       T H A T the use of the appropriate delegated powers be endorsed, to enable J to continue in employment for a period until 30th June, 2018 with the hours remaining at 22 per week (as previously agreed by the Committee at its meeting held on 27th November, 2016) effective from 1st April, 2018.

 

(3)       T H A T the retirement of J from the employment with the Council take place on or before 1st July, 2018.

 

Reasons for decisions

 

(1)       To determine the extension of the existing flexible retirement arrangements within the Regulations and to allow for eventualities that may not be known at this time.

 

(2&3)  To achieve the necessary change to the employee’s flexible retirement date, to assist service continuity, to provide appropriate support to assist the employee’s transition to retirement, to contribute to ongoing change management projects within the Council and Schools.  The reduction in hours would also represent a limited financial saving for the Directorate without significant detriment to the team or service provision.

 

 

793     APPLICATION FOR FLEXIBLE RETIREMENT – H (EXEMPT INFORMATION – PARAGRAPHS 13 AND 14) (DLS) –

 

Consideration was given to an application for flexible retirement in respect of one employee within the Directorate of Learning and Skills.

 

RESOLVED –

 

(1)       T H A T the flexible retirement of H be approved in accordance with the Council’s Policy subject to no other circumstances arising in the interim whereby the employment were to be terminated for a different reason.

 

(2)       T H A T the use of the appropriate delegated powers be endorsed, to enable H to reduce their contracted hours from 37 to 22 hours per week from week commencing 1st April, 2018, with the retirement of H from the employment with the Council taking place on or before 31st March, 2020.

 

Reasons for decisions

 

(1)       To determine the flexible retirement application within the Regulations and to allow for eventualities that may not be known at this time.

 

(2)       To achieve the necessary change in the employee’s working hours, to assist service continuity, provide appropriate support to assist the employee’s transition to retirement and to enable the service to restructure to maximise its ability to achieve the service aims within current legislation whilst planning for the implementation of the new Additional Learning Needs and Education Tribunal (Wales) Act 2018, which would come into force in 2020.

 

 

794     APPLICATION FOR PHASED RETIREMENT – S (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (DLS) –

 

Consideration was given to an application for phased retirement in respect of one employee within the Directorate of Learning and Skills.

 

RESOLVED –

 

(1)       T H A T the phased retirement of S be approved in accordance with the Teachers’ Pension Scheme subject to no other circumstances arising in the interim whereby the employment were to be terminated for a different reason.

 

(2)       T H A T the use of the appropriate delegated powers be endorsed, to enable S to reduce their contracted hours from 37 to 22 hours per week from 1st September, 2018, with it being noted that S’s employment would continue with the Council on an open ended basis in accordance with the provisions of the Teachers’ Pension Scheme.

 

Reasons for decisions

 

(1)       To determine the phased retirement application within the provisions of the Teachers’ Pension Scheme.

 

(2)       To achieve the necessary change to the employee’s working hours and provide appropriate support to assist the employee’s transition through a phased retirement process and to reflect the provision of the Teachers’ Pension Scheme to facilitate a phased retirement of the employee.

 

 

795     MATTER WHICH THE CHAIRMAN HAD DECIDED WAS URGENT –

 

RESOLVED – T H A T the following matter which the Chairman had decided was urgent for the reason given beneath the minute heading be considered.

 

 

796      APPLICATION FOR FLEXIBLE RETIREMENT – J (EXEMPT INFORMATION – PARAGRAPHS 13 AND 14) (DSS) –

(Urgent by reason of the need to make a decision prior to 1st April, 2018)

 

Consideration was given to an application for flexible retirement in respect of one employee within the Directorate of Social Services.

 

RESOLVED –

 

(1)       T H A T the flexible retirement of J be approved in accordance with the Council’s Policy subject to no other circumstances arising in the interim whereby the employment were to be terminated for a different reason.

 

(2)       T H A T the use of the appropriate delegated powers be endorsed, to enable J to reduce their contracted hours from 30 to 18 hours per week from week commencing 1st April, 2018, with the retirement of J from the employment with the Council taking place on or before 31st March, 2022.

 

Reasons for decisions

 

(1)       To determine the flexible retirement application within the Regulations and to allow for all eventualities that may not be known at this time.

 

(2)       To achieve the necessary change to the employee’s working hours, to assist service continuity, provide appropriate support to assist the employee’s transition to retirement and to reinvest the savings to meet the needs of the service.
