STATUTORY LICENSING SUB-COMMITTEE

 

Minutes of a meeting held on 9th October, 2017.

 

Present:  Councillors K.P. Mahoney, M.J.G. Morgan and Mrs. J.M. Norman.

 

Also present: Licensing Officer (Vale of Glamorgan Council) and Responsible Authority Environmental Health Department.

 

Also present: Representing the Applicant (Mr. J. Hardy) Mr. M. Grant and Mrs. T. Kemp.

 

 

(a)       Appointment of Chairman –  

 

RESOLVED – T H A T Councillor M.J.G. Morgan be elected Chairman for the hearing.

 

 

(b)       Declarations of Interest

 

Councillor K.P. Mahoney

Personal and prejudicial   interest in that he had long time knowledge / association with one of the   Applicant’s representatives (Mr. Grant) whose name was not on the   original application.

 

 

(c)        Licensing Act 2003 – Application for the Variation of a Club Premises Certificate – Penarth Labour Club, 98/100 Glebe Street, Penarth, CF64 1ED

 

In the light of Councillor Mahoney’s declared interest, the Chairman informed the Applicant’s representatives that the hearing was unable to proceed as the Sub-Committee would be inquorate due to Councillor Mahoney’s declaration of interest.  It was his intention to adjourn the hearing to a future date to be agreed to allow the Sub-Committee to be reconstituted to hear the Application.  He asked the Applicant’s representatives to inform the Council’s Licensing Officer of the named individuals who would be representing the Applicant in advance of the reconvened hearing.  In response, Mr. Grant indicated that it would be himself and Mrs. Kemp representing the Applicant at the reconvened hearing.

 

RESOLVED – T H A T the hearing be adjourned to allow the Sub-Committee to be reconstituted and to consider the Application on a date to be confirmed.

 

Reason for decision

 

The Sub-Committee was unable to hear the case for the Applicant as a result of Councillor Mahoney’s declared interest.
