(2)       T H A T the Terms of Reference of the Sub-Committee, and the allocation of functions between the Planning Committee, the Sub-Committee and officers as approved by the Planning Committee on 15th April, 2010 be approved, namely:

 

"To consider and determine under delegated powers applications for Footpath Orders made under Sections 25, 26, 118 and 119 of the Highways Act 1980 and Orders made under Sections 53(3)(b), 53(3)(c) and 54 of the Wildlife and Countryside Act 1981 in respect of modifications of the Definitive Map.

(i)         Welsh Assembly Government Consultation on Draft Technical Advice Note 20 “Planning and the Welsh Language”

 

Cabinet, on 18th May, 2011, had been advised of the Welsh Assembly Government consultation on the draft Technical Advice Note 20 “Planning and the Welsh Language” and were requested to approve the Council’s formal response to the consultation questions which was attached at Appendix A to the report.

(1)       That the response attached at Appendix A to the report be approved as the Council’s formal response to the consultation on the revised version of Technical Advice Note 20.

 

(2)       That a copy of the report be submitted to Planning Committee for information purposes.

(ii)        Welsh Assembly Government Consultation: Review of Directions Requiring Planning Applications to be Referred to Welsh Ministers

 

Cabinet, on 18th May 2011 had been advised of consultation by the Welsh Assembly Government on the review of Directions requiring planning applications to be referred to the Welsh Ministers, and considered a response to the same.

 

Cabinet had resolved “that, subject to consultation with the Planning Committee, the response attached at Appendix B to the report be approved as the Council’s formal response to the consultation paper”.

(iii)       Windsor Road (Part), Penarth: Proposed Disabled Persons Parking Place: Objection Received -

 

Committee were advised of an objection received to a proposal to install a disabled persons parking place in Windsor Road, Penarth, and were requested to assess its merits and to make a recommendation.

 

A Mr. William Dadd, of 144 Windsor Road, Penarth, had applied on behalf of his daughter, Miss. Sarah Dadd for the installation of a disabled persons parking place outside their home.  Miss. Dadd was a non-driver and a disabled blue badge holder.  The application met all the criteria of the current policy for the provision of disabled persons parking places.

 

The section of Windsor Road, Penarth, where the proposed disabled persons parking place was to be installed was a long section of terraced properties which suffered from extraneous parking, mainly from residents residing within the area. 

 

Statutory consultations and public notice of the Council’s intention to create a Traffic Regulation Order for the disabled persons parking place was given on 17th March 2011. 

 

An e-mail of objection had been received to the proposal from a resident of Windsor Road, Penarth. 

 

The objector had stated that: 

 

I strongly object to the proposed disabled parking bay in Windsor Road, Penarth.  I feel the proposed bay is unnecessary and unjustified.  The bay will take up two parking spaces and will cause even bigger parking problems for myself and the other residents it if goes ahead.  It would only serve to permanently reserve a large space which will make the already difficult parking situation even worse, causing a lot more problems.

 

There are many existing Blue Badge holders in the street that would use the disabled parking bay so it wouldn’t benefit the person requesting the bay.

 

My daughter works as a courier and relies on a parking space near our house to load and unload her vehicle.  The proposed parking bay will have a very negative impact on her job.  Her job may be in jeopardy if the bay is granted as we live directly next door to where the bay will be.  It is very likely the bay will over hang our gateway to our house.”

 

A number of parking surveys had been undertaken on Windsor Road at various times of the day, evening and weekend, all of which confirmed that this section of Windsor Road suffered from extraneous parking throughout the day.

 

The Traffic Signs Regulations and General Directions 2002 state that the recommended length for a disabled persons parking bay was 6.6m.  This length was specifically recommended to assist disabled people exiting the vehicle safety when using a wheelchair or crutches.  Site investigations had been undertaken, and in this instance it was recommended that the proposed disabled persons parking place be installed to a length of 5.5m which was the frontage length of the applicant’s property.  This would alleviate any possible concerns of the parking place being installed in front of adjacent properties. 

 

A disabled persons parking place, once installed on the carriageway, was for the use of any disabled Blue Badge holder. 

 

Having considered the report, it was

 

RESOLVED -

 

(1)       T H A T an Order be made under the Road Traffic Regulation Act 1984, the effect of which would be to install a disabled persons parking place outside 144 Windsor Road, Penarth.

 

(2)       T H A T the objection received be rejected, and that the objector be advised accordingly.

 

Reasons for decisions

 

(1)       To allow the Traffic Regulation Order to be made and implemented.

 

(2)       To comply with the requirements of the above legislation.

RESOLVED - T H A T the making of any Experimental Traffic Regulation Order be deferred to allow for consultations to be undertaken with the residents of all affected residential streets and with the businesses located on Broad Street, High Street and Park Crescent, Barry.

5.         The access to the caravan site shall only be via the access point located in the eastern corner of the site and not from any other point.

           

            Reason:

6.         The caravan park hereby approved shall not be brought into beneficial use until such time as revised details of the gated access, which shall provide a 6 metre wide clear opening and include full details of the proposed gates (to a scale of 1:100) have been submitted to and approved in writing by the Local Planning Authority and the agreed access arrangements have been constructed in accordance with the approved details.

           

            Reason:

           

            In the interest of highway safety to ensure a satisfactory form of access to serve the development and to comply with the terms of Policy ENV27 of the Unitary Development Plan.

 

7.         The caravan park hereby approved shall not be brought into beneficial use until such time as the vegetation overhanging the highway verge has been cut back and cleared to provide clear vision splays of 3 metres by 90 metres in both directions, which shall be maintained at all times thereafter.

           

            Reason:

           

            In the interest of highway safety to ensure a satisfactory form of access to serve the development and to comply with the terms of Policy ENV27 of the Unitary Development Plan.

 

8.         Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, or any Order revoking or re-enacting that Order, no gates, fences, walls or other means of enclosure shall be erected, constructed or placed on the application site without the prior written consent of the Local Planning Authority, other than those approved in connection with Condition No. 6 of this planning permission.

           

            Reason:

           

            To safeguard local visual amenities, and to ensure compliance with the terms of Policies ENV27 and TOUR4 of the Unitary Development Plan.

 

9.         A landscaping scheme shall be submitted to and approved in writing by the Local Planning Authority which shall include indications of all existing trees and hedgerows on the land, details of any to be retained, together with measures for their protection in the course of development and details of the proposed hedge bank and scheme for the planting of native trees.

           

            Reason:

           

            To safeguard the visual amenities of this rural area and to ensure compliance with the terms of Policies ENV1 and ENV27 of the Unitary Development Plan.

 

10.      All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding seasons following the commencement of the use of the site as a touring caravan park; and any trees or plants which subsequently die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.

           

            Reason:

           

            To ensure satisfactory maintenance of the landscaped area, to protect the amenities of the neighbouring properties to ensure compliance with Policies ENV11, TOUR4 and ENV27 of the Unitary Development Plan.

 

11.      Prior to their erection/construction on site, full details and specifications of the proposed power hook up points/lighting bollards, CCTV pole, recycling compound, security barriers and emergency access gates (including drawings to a scale of 1:10, 1:50 and 1:100) as appropriate, shall be submitted to and approved in writing by the Local Planning Authority and the development shall thereafter be carried out in full accordance with the agreed details.

(ii)        That the Vale of Glamorgan Council requests that full discussions are entered into with regard to the need to ensure that access is provided to the Barrage car park for sustainable transport with particular emphasis on the provision of a safe and convenient bus stopping area for possible transport that serves Penarth Marina and the Barrage.

(iii)       The Vale of Glamorgan Council requests that consideration be given to likely noise impacts on residents in close proximity to the site at Penarth Marina and Northcliffe as to whether the hours of operation should be limited and/or a temporary consent granted for more limited hours of operation pending a full assessment of these potential impacts.
