Minutes of a meeting held on 1st June, 2017.

 

Present:  Mr. J.F. Baker, Mr. A.G. Hallett, Councillors Mrs. A. Moore and Mrs. R. Nugent-Finn.

 

 

13        APPOINTMENT OF CHAIRMAN -

 

Mr. A.G. Hallett was appointed Chairman of the Standards Committee until the end of his term of office. 

 

 

14        APPOINTMENT OF VICE-CHAIRMAN -

 

Mr. A. Lane was appointed Vice-Chairman of the Committee for the current municipal year.

 

 

15        APOLOGIES FOR ABSENCE -

 

These were received from Mr. A. Lane and Councillor B.T. Gray.

 

 

16        MINUTES -

 

RESOLVED - T H A T the minutes of the meeting held on 25th January, 2017 be approved as a correct record.

 

 

17        DECLARATIONS OF INTEREST -

 

Councillor Mrs. A. Moore declared an interest in Agenda Item No. 9 “Applications for Dispensation” in respect of her and Councillor N. Moore’s applications for dispensation.  It was subsequently agreed that those applications would be considered at the end of the agenda item.

 

 

18        CODE OF CONDUCT TRAINING AND ATTENDANCE FOR VALE OF GLAMORGAN COUNCILLORS POST 2017 LOCAL GOVERNMENT ELECTIONS (MO) -

 

The report provided the Committee with the details of the training that had been offered to all Members of the Vale of Glamorgan Council following the elections on 4th May, 2017.  The Monitoring Officer in presenting the report advised that 44 Vale of Glamorgan Councillors had attended the Code of Conduct training sessions with the remaining three Members being invited to attend further sessions with the Monitoring Officer.  A copy of the presentation that had been presented at the sessions was attached for the Committee’s information.  A video provided by the Public Services Ombudsman for Wales, Nick Bennett, had also been shown to attendees and Members had been given a series of hypothetical scenarios with the opportunity to feedback and discuss the same.  Feedback to date had been very positive.  The report also noted that training for Members of Town and Community Councils within the Vale would be delivered by the organisation One Voice Wales (the Voice of Community and Town Councils in Wales), later in the year, the cost for which would be met by the Vale of Glamorgan Council. 

 

In considering the report, a Member raised the issue of the ICT equipment that had been provided to all Members by the Vale of Glamorgan Council for their use in their Councillor work.  It was suggested that information relating to the parameters for such use should be compiled.  The Monitoring Officer advised that she had recently received a copy of an email that had been forwarded to all Members regarding the ICT Code for the use of such equipment which she considered would hopefully address concerns. 

 

Following consideration of the report it was subsequently

 

RESOLVED –

 

(1)       T H A T the contents of the report be noted.

 

(2)       T H A T a copy of the Vale of Glamorgan Council’s ICT Code of Conduct  April 2016 (as outlined above) be presented to a future meeting of the Standards Committee.

(1)       In recognition of the training that had been undertaken to date.

19        THE LOCAL AUTHORITIES (MODEL CODE OF CONDUCT) (WALES) (AMENDMENT) ORDER 2016 TOWN AND COMMUNITY COUNCILS (MO) -

 

At the Standards Committee meeting held on 25th January, 2017 Members had been  informed that feedback was awaited from Sully and Lavernock Community Council and Michaelston le Pitt with Leckwith Community Council in respect of their compliance with the Local Authorities (Model Code of Conduct) (Wales) (Amendment) Order 2016 (“the 2016 Order”).

 

Section 51(6) of the Local Government Act 2000 required the relevant Authority, as soon as reasonably practicable after revising its Members’ Code of Conduct (“the Code”) to ensure that copies of the revised Code were available at an office of the Authority, for inspection by the public at all reasonable hours.  They also had to publish in one or more newspapers, circulated in the area, a notice which stated that the Authority had revised the Code and made it available for inspection as well as to send a copy of the revised Code to the Public Services Ombudsman for Wales.

 

The Monitoring Officer, in advising the Committee, stated that Michaelston le Pitt with Leckwith Community Council had confirmed that their revised Code had been adopted at the Council’s meeting on 1st November, 2016 and had been published on the Council’s notice boards, including where copies would be made available, in November 2016.  The notices had also been published on the Council’s website in November 2016 including a download link to the actual document.  A copy of the revised Code was sent to the Ombudsman in early January 2017 and a notice was published in the Penarth Times in February 2017. 

 

For Sully and Lavernock Community Council, the Clerk had confirmed that the Community Council approved the revised Code at an extraordinary meeting held on 19th July, 2017 and a copy of the same was forwarded to the Public Services Ombudsman for Wales on 26th July, 2016.  The notice of the adoption of the revised Code was published in the Penarth Times on 19th January, 2017 and a copy of the same had been made available for inspection since approval by the Council and a copy had also been made available on the Community Council's website for inspection.

 

Although it was noted that the Michaelston le Pitt with Leckwith Code had been adopted outside the statutory timescale, Committee was informed that all Town and Community Councils within the Vale had now complied with the 2016 Order.

 

In considering the report, a Member referred to the fact that he had noticed that St. Donats Community Council did not have a website and requested that the Monitoring Officer look into the matter.

 

Having considered the report, it was subsequently

20        DELEGATED POWERS TO CONSIDER APPLICATIONS FOR DISPENSATION -

 

The Committee was apprised of the recent use of the Monitoring Officer’s delegated powers in consultation with the Chairman of the Standards Committee. 

 

At the Full Council meeting on 1st March, 2017 (Minute No. 957), following a recommendation from the Standards Committee of 25th January 2017, Full Council had resolved that the Monitoring Officer, in consultation with the Chairman or, in his absence, the Vice-Chairman of the Standards Committee be granted delegated powers to consider, refuse or approve urgent applications for dispensation on behalf of the Standards Committee and thereafter report the use of such delegations to the next relevant meeting of the Standards Committee.

 

Following the Local Government elections in May 2017 a number of dispensation applications had been received.  Following consideration by the Monitoring Officer and the Chairman of the Standards Committee on 23rd May, 2017 the following dispensations were granted until the next Local Government Elections:

  • Vale of Glamorgan and Barry Town Councillor Ms. J. Aviet to speak and vote at meetings of both Councils where matters involving the Vale of Glamorgan Council's Reshaping Services strategy are discussed (paragraphs c and d)

21        APPLICATIONS FOR DISPENSATION (MO) -

 

The Standards Committee (Grant of Dispensations) (Wales) Regulations 2001 permitted Members to apply to a Standards Committee to speak and, if appropriate, to vote on matters concerning which, due to a prejudicial interest, they might not otherwise be able to speak or vote.  Following consideration of the number of applications as contained within the report it was

(2)       T H A T with regard to the following applications, the Councillors be advised accordingly:

 

Councillor  M.R. Wilson –

  • In respect of the dispensation applications for the Cardiff and Vale College and the Glyndwr Community Association applications be resubmitted providing the detail of the prejudicial interest and reasons to support the applications;
  • In respect of Victoria School (Vice-Chairman) – as a Local Authority appointed Governor, the Councillor is currently eligible to speak and vote at meetings unless the exemption as detailed at paragraph 18.3.3(c) of the Council’s Constitution applies.  However, if there is a further issue that the Standards Committee may not be aware of, that Councillor Wilson be advised to seek advice from the Monitoring Officer in the first instance.

Councillor Mrs. S. Hanks –

  • In respect of the application for dispensation in relation to the LDP –  that, as there appeared to be no prejudicial interest detailed within the application, Councillor Mrs. Hanks be advised that she would be eligible to speak and vote at meetings in her capacity as a Councillor.

(3)       T H A T all Councillors are advised that in future where multiple applications for dispensations are to be submitted, single applications for each dispensation are required.

 

Reasons for decisions

 

(1)       To comply with the Standards Committees (Grant of Dispensations) (Wales) Regulations 2001 governing applications for the grant of dispensations to speak / speak and vote to the Standards Committee.

 

(2)    Having regard to the information contained within the applications.

 

(3)     For clarity purposes.

 

N.B. Councillor Mrs. A. Moore left the room when the applications for dispensation for herself and Councillor N. Moore were being discussed.
