REPORT OF THE CHIEF EXECUTIVE

 

 

SCRUTINY COMMITTEES: APPOINTMENT, MEMBERSHIP AND TERMS OF REFERENCE

 

Attached as Appendix A is a proposed list of Scrutiny Committees, together with the number of seats to which each political group is entitled.  As can be seen, the proposal is that each Scrutiny Committee comprise 10 members compared to the previous 11. 

 

Attached at Appendix B is Article 6 of the Constitution which sets out the terms of reference, general role and specific functions of the Scrutiny Committees.  Members are asked to consider a proposed amendment to the terms of reference of the Scrutiny Committee (Lifelong Learning) by the addition of the words "Catering Service" and to agree the amendment of Article 6 of the Constitution to reflect such.  Similarly, in paragraph 6.02, agreement is sought to the replacement of the words "Best Value" by the words "Continuous Improvement" (again with the Constitution to be amended accordingly). Both proposed amendments are included in Appendix B.

 

Appendix C is the calculation relating to the political balance requirement for Committees in accordance with the Local Government and Housing Act 1989.

 

Members' attention is drawn to a new requirement, under the Local Government (Wales) Measure 2011 regarding the allocation of Scrutiny Committee Chairmen positions.  In essence, any Group, or Groups, represented on the Executive are entitled (when taken together) to a proportion of Scrutiny Committee Chairmen positions equivalent to their total number of seats (when taken together) on the Council.  Once this calculation has been done, the remaining Scrutiny Committee Chairmen positions become the "property" of the non-executive Groups (again, to be allocated proportionate to the total number of seats held by the respective Groups on the Council). 

 

In calculating the above, the figure relating to groups represented on the Executive must, in all cases, be rounded down.  The figure for non-executive allocations is to be rounded up, or down, as appropriate to the nearest whole number.

 

The calculation / allocations shown below reflect the above, and taking into account the understanding that the Labour and Llantwit First Groups are forming a coalition and that three newly elected Independent Members have formally registered themselves as a Group in accordance with the provisions of the Local Government (Committees and Political Groups) Regulations 1990.  As such, the allocation for the appointment of the five Scrutiny Committee Chairmen positions is as follows:

 

Labour / Llantwit First (when taken together) – 2

Conservative – 1

Plaid Cymru – 1

Independent - 1

 

In order to give effect to the above, and following discussions between Group Leaders, it is proposed that paragraph 8 of Part 4(E) of the Constitution : Overview and Scrutiny Procedure Rules be amended to read be Article 8 of the Constitution be amended to read :

 

“ 8. WHO CHAIRS SCRUTINY COMMITTEE MEETINGS?

 

Chairmen of Scrutiny Committees / sub-committees / task and finish groups will be drawn from among the councillors sitting on the relevant committee / sub-committee / task and finish group, and subject to this requirement the committee / sub-committee / task and finish group may appoint such a person as it considers appropriate.

 

In the case of Scrutiny Committees, the appointment of the Chairman of each Committee will take place at the Annual Meeting of the Council and will reflect the requirements, under the Local Government (Wales) Measure 2011 regarding the allocation of Scrutiny Committee Chairmen positions.

 

The intention, on this occasion is that the Council be recommended to endorse the allocation of specific Scrutiny Committee Chairman as notified by the relevant Group Leaders at the Council Meeting.

 

 

RECOMMENDED – T H A T

 

(1)       T H A T the Scrutiny Committees together with their Membership and Terms of Reference (as amended) be appointed for the ensuing municipal year and the Constitution amended accordingly.

 

(2)       T H A T In order to give effect to the requirements of the Local Government (Wales) Measure 2011 regarding the allocation of Scrutiny Committee Chairmen appointments, paragraph 8 of Part 4(E) of the Constitution : Overview and Scrutiny Procedure Rules be amended as set out above

 

(2)       T H A T the Council endorse the allocation of specific Scrutiny Committee Chairman as notified by the relevant Group Leaders at the meeting
