Report of the Cabinet Member for Education and Lifelong Learning

 

Cowbridge Comprehensive lower site - Transfer of part of the former playing field from Learning and Development to Parks and Grounds Maintenance

 

Purpose of the Report

1.             To request Cabinet approval for the appropriation of land from Learning and Development to Parks and Ground Maintenance following the closure of the Cowbridge Comprehensive Lower site.

Recommendations

1.             That the land identified in Appendix A as being within the Councils ownership is appropriated from the Directorate of Learning and Development to the Directorate of Environmental and Economic Regeneration (Parks and Ground Maintenance)

2.             That the Director of Finance, ICT and Property, in consultation with the Director of Learning and Development and Director of Environmental and Economic Regeneration, be authorised to undertake the appropriation of the land to Parks and Ground Maintenance.

Reasons for the Recommendations

1.             To allow the continued efficient management of the playing field facility within Cowbridge.

2.             To ensure the legal transfer, including all rights and responsibilities of the land from Learning and Development and Parks and Ground Maintenance.

Background

2.             In September 2010 Cowbridge Comprehensive School vacated the former lower site on Town Mill Road and transferred to the new site on Aberthin Road. The comprehensive school continued to use the lower site playing field to allow the new sports pitches to establish until July 2011. The school are now making full use of the new sports pitches on Aberthin Road and the lower site playing fields are no longer required by the school.

3.             The ownership of the playing field is divided between the Vale of Glamorgan Council which owns the western section known as the Police Field as shown on the plan (Appendix A),as hatched red whilst the eastern portion (Cricket Field) is owned by the Cowbridge Comprehensive Trust shown on the plan as cross hatched blue.

4.             As the Cowbridge Comprehensive Trust is independent of the Council, this report only relates to that part of the playing fields within the ownership of the Council, i.e. the area of land hatched red on the attached plan known as the Police Field

5.             As the playing fields are no longer required for education purposes and in order to ensure the future effective and efficient management of that part of the playing field within the Council's ownership, it is proposed that the area currently held by Learning & Development be transferred to Parks and Ground Maintenance.

Relevant Issues and Options

6.             The land has been school playing fields for many years and has been used by local clubs with the agreement of the Comprehensive School. There is a deficiency in the area of available playing fields and the transfer of this site to Parks and Ground Maintenance will retain this area for public use and ensure the continued efficient good management of the playing field.

7.             Although the land is under the remit of Learning and Development and has been used primarily as school playing fields, for many years local sports clubs and the community have also made use of this land. The appropriation of the land to Parks and Ground Maintenance will therefore not alter the current use of this land.

Resource Implications (Financial and Employment)

8.             The Directorate of Learning and Development will pay all reasonable fees incurred by the appropriation of this land.

9.             Budgets allocated to the maintenance of the school playing field have remained with the school to maintain their new enlarged playing fields on Aberthin Road. There will be no transfer of funding associated with the appropriation of the land.

10.        All grounds maintenance and management costs associated with that part of the playing fields hatched red on the attached plan will transfer from Learning and Development to Parks and Ground Maintenance

11.        A local authority may appropriate land from one purpose to another when it is no longer required for the purpose for which it was previously held.

12.        There are no crime and disorder implications arising from this matter.

14.        This proposal will ensure continued efficient management of the playing field for use by the local community.

15.        The appropriation of the identified land is a matter for Executive decision.

Consultation (including Ward Member Consultation)

16.        Consultation with local ward members has been undertaken; they have expressed their agreement to this proposal.
