Changes to Representation on Outside Bodies

Purpose of the Report

1.    To consider a number of changes to the Council's existing representation on outside bodies.

Recommendations

1.    That the changes to representation on outside bodies, as set out in the report, be approved.

 

2.    That the process for appointing the Council’s representatives on the Cardiff and Vale Community Health Council, as set out in paragraph 6 of the report, be approved.

 

3.    In the event of external appointments to the Cardiff and Vale Community Health Council being required, the Managing Director be granted delegated powers, in consultation with the Leader and the Head of Democratic Services, to consider and determine the applications and to forward the approved applications to the Board of Community Health Councils.  

Reasons for the Recommendations

1.    To ensure continuity of representation by the Council on the outside bodies concerned.

 

2&3.    To facilitate the Council’s representation of three Members on the Cardiff and Vale Community Health Council.

Background

2.    Historically, the Council has appointed / nominated representatives to sit on a large number of outside bodies / joint committees.  The majority of existing appointments were approved by Cabinet on 30th May 2012, with appointments/ nominations generally running until the Council elections in 2017.  

Relevant Issues and Options

3.    For a variety of reasons, it has been necessary to review the Council's existing representations on certain outside bodies.  Set out below is a table of the bodies concerned, indicating current, and proposed, replacement representatives.  It can be seen that, in a number of cases, actual representatives have yet to be identified.

(Former) Environment Agency) Flood Risk Management Wales Committee Cabinet Member (Environment and Visible Services) Natural Resources Wales (NRW) have referred to a proposal under the Environment Bill to abolish the Committee as its primary function is to oversee NRW’s Capital Programme and this is now undertaken by NRW’s Board. As such, NRW have decided that there is no point inviting a nomination from the Council for the time being.

4.    As far as the Cardiff and Vale Community Health Council is concerned, the level of commitment required has led, over many years, to nominated Members eventually being unable to devote the time required to undertake the role.  This is an issue which has arisen in a number of Community Health Councils across Wales and has led to the Welsh Government consulting on, and recently introducing, changes to the process by which Local Authorities are able to appoint representatives to Community Health Councils.  The changes mean that Local Authorities still have to appoint “at least one” Elected Member, with the remaining Members nominated to be of the Local Authority’s choosing.  Welsh Government has indicated that their hope is that this will ease the burden on Elected Members who, clearly, have had difficulties in fulfilling the role (given their other commitments), whilst at the same time allowing Local Authorities to be represented.  

 

5.    Both this Council and Cardiff Council are required to make 3 appointments.  

 

6.    With regard to all of the above vacancies, Group Leaders have been asked if they wish to nominate any Members from within their respective Groups for consideration by Cabinet.  Any nominations received will be reported to Cabinet.  

 

7.    In order to inform the process regarding the Community Health Council appointments, Group Leaders have been provided with a Welsh Government guidance document setting out information for prospective "candidates".  It is important that any Member interested in the role(s) takes account of the guidance (given the background alluded to above).   If no, or insufficient, elected Members come forward, details of the process and the opportunity for individuals to apply for the role(s) will be placed on the Council’s website and in a local newspaper.  

 

8.    In the event of external appointments being required, it is proposed that the Managing Director be granted delegated powers, in consultation with the Leader and the Head of Democratic Services, to consider and determine the applications and to forward the approved applications to the Board of Community Health Councils.  The Board, in turn, forwards details of eligible applicants to the Welsh Government for processing.

11.    There are no specific implications arising from the report.  Responsibility for the appointment of Members / officers to outside bodies in respect of Executive functions, and the revocation of any such appointment, rests with the Cabinet.
