Civil Parking Enforcement - Progress
Purpose of the Report
1. To advise the Committee of progress being made towards obtaining Civil Parking Enforcement powers.
1. That the Committee notes the contents of the report.
Reason for the Recommendation
1. For information.
2. A request was made at the Community Liaison Committee meeting of 18th January 2012 for an update on progress being made towards obtaining Civil Parking Enforcement powers.
3. A report was presented to Cabinet on 19th January 2011 entitled 'Civil Parking Enforcement'. This report advised Members of the then current position regarding Civil Parking Enforcement and presented a Business Case supporting the proposal that the Council progressed an application to the Welsh Assembly Government to become a Civil Enforcement Authority. Cabinet resolved the following:
(1) That the current position with regard to parking enforcement by the police and the subsequent position with regard to Civil Parking Enforcement (CPE) be noted.
(2) That the Business Case and the financial model for the introduction of CPE be approved.
(3) That an application to the Welsh Assembly Government (WAG) for an order to designate the whole of the Vale of Glamorgan as a Civil Enforcement Area be approved.
(4) That use of up to £300,000 from Visible Services Reserves to fund costs of the application process and make necessary appointments be approved.
(5) That reports be provided to Cabinet at regular intervals specifying options for the delivery of future enforcement and detailing the project position and spend.
4. A further report was presented to Cabinet on 29th February 2012 entitled 'Civil Parking Enforcement - Progress'. This report provided an update on progress and sought Members' approval to progress with a joint service provision of CPE with Bridgend County Borough Council. In addition, approval was sought for the Cabinet Member for Visible and Building Services to be granted delegated authority to agree the apportionment of costs and income and to appoint a back office provider. Cabinet resolved the following:
(1) That the contents of the report be noted.
(2) That the joint service provision of Civil Parking Enforcement with Bridgend County Borough Council be approved.
(3) That detail of the apportionment of costs and income and appointment of a back office service provider be reported to Cabinet for approval.
(4) That a further progress report be presented to Cabinet by the end of June 2012.
Relevant Issues and Options
5. It is intended that the Council will obtain CPE powers by April 2013. A programme indicating the steps required to progress an application to the Welsh Government (WG) for CPE powers is attached at Appendix 'A' to this report. A description of the progress to date is indicated below.
Review of Traffic Regulation Orders, Signs and Lines
6. Following a competitive tendering process, Alpha Parking were appointed to undertake a review of existing traffic regulation orders (TROs), signs and lines. Their tender sum was £47,987. This commission commenced in October 2011 and is programmed to be completed by the end of February 2012.
7. Any discrepancies between the TROs, signs and lines will have to be addressed prior to any submission to WG.
Production of Map-based Schedules
8. It is intended to present details of TRO schedules in a map format. This should make this information more readily accessible for both staff and members of the public in the future. To facilitate this, the software package ParkMap has been purchased from Buchannan Computing.
9. As part of their commission, Alpha Parking are required to populate ParkMap with details of the TROs following their review of the signs and lines. This task is in hand and is anticipated to be completed by the end of February.
Civil Enforcement Area Application
10. In due course, a formal application will be made to WG. As part of this application, the Council has to confirm that a TRO review has been undertaken and that the associated signs and lines are fit for purpose. In addition, the submission has to include the following:
the Council's Parking Management Strategy;
a Financial Assessment;
an indication as to how the Notice Processing function will be undertaken;
the proposed number and deployment of Civil Enforcement Officers (CEOs);
the proposed extent of the training of CEOs;
a description of the uniforms and equipment to be provided to CEOs;
the proposed Penalty Charge Notice (PCN) levels;
the proposed methods of payment to be made available;
proposed exemptions and dispensations;
proposals for vehicle immobilisation and removal;
proposals for dealing with representations and appeals;
the proposed method of adjudication;
the proposed method of PCN recovery;
the proposed publicity programme;
the proposed consultation list;
the proposed reporting method to be used.
Joint Service Provision
11. The Vale of Glamorgan Council and Bridgend County Borough Council (BCBC) have established a Joint Working Programme Board to consider opportunities for joint service provision. It has been proposed that the provision of CPE be undertaken jointly and to this end a project team has been established comprising officers from both authorities. Miles Punter, the Council's Head of Visible Services is currently chairing the Project Board and Gary Owen, Client and Business Team Leader (BCBC) is Project Manager with day-to-day responsibilities for planning and management of the project throughout all its stages.
Resource Implications (Financial and Employment and Climate Change, if appropriate)
12. Cabinet approved that up to £300,000 be made available from Visible Services Reserves to progress the CPE application. Costs to date are £60,360 and comprise the following:
£20,380 (cost estimate)
£47,987 (tender sum)
13. The management of the CPE application process is being undertaken by the Council's Highway Projects and Traffic Management Group, Highways and Engineering.
14. There are no Climate Change Implications with regard to this report.
Legal Implications (to Include Human Rights Implications)
15. The Road Traffic Regulation Act 1984 allows highway authorities to make and vary Orders to regulate the movement of vehicular traffic and to improve the amenities of an area.
16. There are no Human Rights Implications with regard to this report.
Crime and Disorder Implications
17. The proposal to take on CPE responsibilities will improve highway safety and the management of the highway network and will reduce the potential for incidents of disorder.
Equal Opportunities Implications (to include Welsh Language issues)
18. The proposals will benefit all sections of the community by improving highway safety and reducing congestion.
19. Traffic signs, parking tickets and all associated documentation related to CPE will adhere to the requirements of the Council's Welsh Language Scheme.
20. To maintain and develop a safe and effective highway.
Policy Framework and Budget
21. This report is within the policy framework and budget.
Consultation (including Ward Member Consultation)
22. No Ward Member consultation has been undertaken with regards to this report as the proposals will affect all areas within the Vale of Glamorgan.
