"C1054          WELSH ASSEMBLY GOVERNMENT CONSULTATION DOCUMENT - LOCAL DEVELOPMENT ORDER (PT) (SCRUTINY - ECONOMY AND ENVIRONMENT) -

 

The aforementioned consultation related to the proposal that Local Planning Authorities (LPAs) had discretion to make Local Development Orders (LDOs) provided for by the Planning and Compulsory Purchase Act 2004 amended by the Planning Act 2008.  WAG considered that LDOs could be a valuable tool as follows:

 

·                    a mechanism whereby minor development could be managed more strategically

·                    a way of reducing unnecessary planning applications being submitted.

 

For the reasons contained within the report, whilst broadly welcoming the principles of LDOs and the proposal to give this Council the ability to make specific provisions relevant to its own area, doubts were expressed as to the usefulness of the provisions.  At a time of increasing resource constraints and the increasing complexity of the planning system, a great deal of preliminary work and resources would need to be targeted in setting out the LDO in the first instance.  Whilst it was accepted that there were circumstances, for example, large single owned business sites where an extension of permitted development rights to grant consent for minor works could aid regeneration, it was considered that a more appropriate way to reduce “unnecessary planning applications” being submitted to LPAs was for WAG itself to extend permitted development rights across Wales thereby ensuring consistency of approach.  A proposed response to the consultation was tabled at the meeting.

 

This was a matter for Executive decision.

 

RESOLVED -

 

(1)       T H A T the release of the WAG Consultation document on Local Development Orders be noted.

 

(2)       T H A T, subject to consultation with the Planning Committee, the response as contained in the report and outlined above to the WAG Consultation on Local Development Orders be approved.

 

Reasons for decisions

 

(1)       To inform Cabinet of the consultation exercise being undertaken by WAG.

 

(2)       To enable Cabinet to respond to the consultation by 29th October, 2010."
