"C1055          WELSH ASSEMBLY GOVERNMENT CONSULTATION: DRAFT LIST OF STATUTORY AND NON-STATUTORY CONSULTEES IN THE PLANNING APPLICATION PROCESS (PT) (SCRUTINY - ECONOMY AND ENVIRONMENT) -

 

The consultation stemmed from WAG’s wish to develop a single comprehensive list of all nationally defined consultees in the planning application process, a similar exercise having been undertaken in England in December 2009.  The purpose of the list was to identify all statutory consultees and other bodies and organisations identified in national policy, guidance and circulars who should be consulted on planning applications.  The key issues for WAG were whether the creation of a list would be a positive contribution, whether all bodies and organisations had been captured on that list and whether the format of the list was useful.  It was considered that a single list which consolidated all consultees and when consultation was necessary, would prove to be a useful reference tool not only to local planning authorities but for applicants and the general public.  It was recognised, however, that the list would need to be regularly updated as and when new guidance was issued.  In terms of the organisation of the list, it was considered that the format followed that currently in place in the General Development Procedure Order with the addition of explanatory text as laid out in the consultation document.  It was considered too that there were a number of other potential omissions on the list such as the National Air Traffic Service and there was no reference of the need to include those consultations necessary were a departure from the Development Plan to be considered.  A proposed response was appended to the report.

 

This was a matter for Executive decision.

 

RESOLVED -

 

(1)       T H A T the release of the WAG Consultation on the provision of a single list of statutory and non-statutory consultees in the planning application process be noted.

 

(2)       T H A T, subject to consultation with the Planning Committee, the response to the Consultation on the introduction of a single list of statutory and non-statutory consultees in the planning application process be approved.

 

Reasons for decisions

 

(1)       To inform Cabinet of the consultation being undertaken by WAG.

 

(2)       To enable Cabinet to respond to the consultation by 26th November 2010."
