Cosy Corner Caterer Trading Without Consent

Published 07 July 2014

The owner of a catering unit on Cosy Corner has been charged with trading without Street Trading Consent under the Local Government Act 1982.

Timothy Kelly of Gwaelod-y-Garth, Cardiff, was trading on ‘Cosy Corner’, Barry Island on Bonfire Night 2013, without having obtained a Street Trading Consent from the Vale of Glamorgan Council permitting him to do so.

The defendant was fined £300, disqualified from driving for 4 weeks and ordered to pay £500 towards the Council’s costs. The fine and costs were to be paid within 14 days.

On 5th November 2013 Licensing Officers went to Barry Island to monitor street trading activity during the Rotary Club Firework Display event. Mr Kelly was advised that he was committing an offence and that he should cease trading, but he refused, telling the officers that they could prosecute him.
