Contaminated Land Searches
Through the conveyance process of house and land purchasing, it
is now quite common for a client to request that the Local
Authority provides any environmental information that they hold
relating to the land in question.
The Pollution Control Section regularly undertakes such requests
for information, particularly with regard to concerns relating to
contaminated land. The most common situation is where a
prospective property purchaser has received an Environmental Search
Report that has identified a potential issue relating to
contamination. In these cases, the client is normally
instructed to contact the Local Authority to confirm whether or not
the land in question is considered to be contaminated.
Unfortunately we cannot issue 'certificates' stating that a
piece of land is free from contamination. Upon request, we
will consult departmental records and electronic datasets relating
to the contaminated land and inform the purchaser of any facts that
we are aware of regarding the property and the immediate area.
We currently charge for contaminated land searches. The
fees are set as £80.40 per hour for domestic properties and £116.40
per hour for commercial properties (inclusive of VAT). In the
first instance, search requests should be sent for the attention of
the Contaminated Land Officer and should clearly state the address
of the property in question and contain a plan outlining the extent
of the land.
