LICENSING SUB-COMMITTEE -
RESOLVED - T H A T the minutes of the meeting
of the Licensing Sub-Committee held on 7th February,
2008 be noted.
890 MINUTES -
RESOLVED - T H A T the minutes of the meeting
of the Licensing Committee held on 12th February 2008 be
accepted, subject to the name of Councillor E. Hacker being
added to the list of those present.

892 APPLICATION FOR
THE GRANT OF A PRIVATE HIRE VEHICLE LICENCE (DLPPHS) -
Mr. C.J. Mort was present in support of his
application.
Committee were asked to consider an
application for the Grant of a Private Hire Vehicle Licence for
Renault S/D Bus registration number Y754 SND by CJ Contract
Services Ltd contrary to the Vale of Glamorgan Council’s Age Policy
Guidelines.
Committee were further asked to consider, in
the same application, for the vehicle to be exempt from Condition
12(d) and (e) of the Vale of Glamorgan Council’s licensing
conditions.
On 14th February 2008, CJ Contract
Travel Services Ltd made an application for the grant of a Private
Hire Vehicle Licence for a Renault S/D Bus, registration number
Y754 SND.
The vehicle was first registered on
19th July 2001 and was therefore outside the Age Policy
Guidelines. A letter was also received requesting that the
Age Policy Guidelines be waived in this case.
On 21st February 2008, the vehicle
was presented for testing at The Alps Depot. The vehicle
failed the plating test as the measurements of the seats did not
comply with the minimum requirements set in condition 12(d) and
(e).
On 21st February 2008, the
Licensing Department had received a letter from Mr. Mort requesting
that condition 12(d) and (e) be waived in relation to this
vehicle.
Mr. Mort had indicated that nearly all newer
vehicles did not have seats that would pass this condition and
requested that the requirements of condition 12(d) and (e) be
waived in this instance.
RESOLVED - T H A T in respect of the
application from CJ Contract Travel Services Ltd for vehicle
registration number Y754 SND:

The Vale of Glamorgan Council’s Age Policy Guidelines be waived
- The
vehicle be exempt from the requirements of condition 12(d) and (e)
of the Council’s conditions relating to Private Hire Vehicles.

The Private Hire Vehicle Licence be granted.

AND PUBLIC -
RESOLVED - T H A T under Section 100A(4) of the Local Government
Act 1972, the press and public be excluded from the meeting for the
following items of business on the grounds that they involve the
likely disclosure of exempt information as defined in Part 4 of
Schedule 12A (as amended) of the Act, the relevant paragraphs of
the Schedule being referred to in brackets after the minute
heading.

HACKNEY CARRIAGE AND PRIVATE HIRE DRIVER’S LICENCES - J.L. (DLPPHS)
(EXEMPT INFORMATION - PARAGRAPHS 12,13 AND 14) -
Mr. J.L. had been invited to attend the
meeting to be interviewed by the Committee to determine whether he
was deemed to be a fit and proper person to hold Vale of Glamorgan
Council Hackney Carriage and Private Hire Vehicle Driver’s
Licences.
Mr. J.L. was not in attendance.
On 15th August 2007, J.L. had
passed the Basic English Test and had made his application for
Hackney Carriage and Private Hire Vehicle Driver’s Licences.
J.L. had subsequently failed three attempts at the Knowledge
Test. On his application, J.L. had indicated that he had two
endorsements, but a subsequent check made with the Criminal Records
Bureau had revealed a number of matters recorded against him.
RESOLVED - T H A T, after careful
consideration of the Licensing Officer’s report and the Criminal
Records Bureau information, J.L. was not considered to be a fit and
proper person to hold a Vale of Glamorgan Council Hackney Carriage
and Private Hire Vehicle Driver’s Licence and his application be
refused due to:
- his
failure to pass the Council’s Knowledge Test on three occasions
- his
failure to declare details of previous convictions recorded against
him, and the nature of those convictions.

HACKNEY CARRIAGE AND PRIVATE HIRE DRIVER’S LICENCES - S.D.G.
(DLPPHS) (EXEMPT INFORMATION - PARAGRAPHS 12,13 AND 14) -
Mr. S.D.G. attended the meeting to be
interviewed by the Committee to determine whether he was deemed to
be a fit and proper person to hold Vale of Glamorgan Council
Hackney Carriage and Private Hire Vehicle Driver’s Licences.
S.D.G. confirmed that he had received the relevant papers.
Mr. S.D.G. had applied to be licensed as a
Hackney Carriage and Private Hire Vehicle Driver on 7th
November 2007 and had successfully completed his Basic English and
Knowledge Tests. On his application form at Section 6,
Mr. S.D.G. had indicated that he had no previous convictions
or cautions. A subsequent check with the Criminal Records
Bureau revealed matters recorded against Mr. S.D.G.
After in depth consideration of the matter,
Home Office Guidelines, Licensing Officer’s report and mitigating
circumstances from the applicant, it was
RESOLVED - T H A T Mr. S.D.G. be considered to
be a fit and proper person and that he be granted Hackney Carriage
Private Hire Vehicle Driver’s Licences but that a written warning
letter be issued in relation to his future conduct with regards to
the necessity to disclose any convictions / cautions to Licensing
Officer within seven days of any offence.

(DLPPHS) (EXEMPT INFORMATION PARAGRAPHS 12,13 AND 14) -
Mr. N..A.F. attended the meeting for the
Committee to determine whether he was a fit and proper person to
hold Vale of Glamorgan Council Hackney Carriage and Private Hire
Vehicle Driver’s Licences. Mr. N.A.F. confirmed that he had
received the relevant papers.
Mr. N.A.F. had applied to be licensed as a
Hackney Carriage and Private Hire Vehicle Driver on 22nd
October 2007 and had successfully completed his Basic English and
Knowledge Tests. On his application form at Section 6,
Mr. N.A.F. indicated that he had no previous convictions or
cautions. A subsequent check with the Criminal Records Bureau
revealed a matter recorded against him.
After in depth consideration of the matter,
Home Office Guidelines, Licensing Officer’s report and mitigating
circumstances from the applicant, it was
RESOLVED - T H A T Mr. N.A.F. be considered a
fit and proper person and that he be granted Hackney Carriage and
Private Hire Vehicle Driver’s Licences.
