MINUTES of a meeting held on 12th
April, 2007.
Present: Councillors E. Hacker, Mrs.

Appointment of Chairman -
Councillor J.W. Thomas was elected Chairman
for the meeting.

No declarations were received.

Licensing Act 2003 - Premises Licence – 6, Plymouth Road,
Barry -
Also present: Mr P Stewart (Applicant), and
Ms. E. Woodfin, Mr. A. Humphreys, Mr. D. Sheppard and Ms.
D. Weaver on behalf of the applicant.
Councillor S. Wiliam on behalf of Mr. A.
Hefferan (interested party).
Consideration was given to an amended
application for the grant of a premises licence to allow the sale
of alcohol for the following hours:
Monday to Saturday
08.00 hours – 21.30 hours
Sunday
08.00 hours – 20.00 hours
The Licensing Officer advised that she had
been informed by a number of the interested parties that they had
no knowledge of the written representations purportedly made by
them.
Mr Stewart, in support of his application,
stated that

He had been teaching martial arts to young people for some 30
years.

He had worked for the prison service, dealing with offenders aged
16 and upwards
-
The housing development at the former Butlins site had led to
greater demand for services in the area.

He lived in the locality.
Mr Stewart pointed out that the premises was
not an off-licence, but a convenience store and post office where
alcohol would be sold. It was not a late night premises.
Mr Stewart also outlined the measures that he
had taken, in addition to those listed in the operating schedule
attached to the application form, namely:

Mr Stewart and his wife had obtained the National Certificate for
Personal Licence Holders, thus meeting the DCMS requirements.

Staff had been aware of the new structures to licensing law and the
importance of complying with the licensing objectives.

Nine internal CCTV cameras and two external CCTV cameras were being
installed.
The Environmental Health Officer advised that,
with regard to the requested condition 1 as detailed within his
memorandum dated 15th March, 2007, Mr Stewart had
been provided with a copy of the “education” pack by an officer of
his department the previous day.
Mr Stewart confirmed that he would be willing
to accept the proposed condition 2 as detailed in the memorandum of
Trading Standards dated 15th March, 2007.
Councillor Wiliam advised that he had been
asked to attend the meeting by Mr. Heffernan in view of Mr.
Heffernan’s concerns about likely crime and disorder issues.
Councillor Wiliam stated that, in his view,
concerns about crime and disorder had been allayed as a result of
what had been said at the meeting, and he was satisfied with the
application and proposed conditions.
Mr Humphreys, in summing up, referred to the
letters of objection which, he stated, were spurious, and which
appeared to have been orchestrated.
This sentiment was echoed by Councillor
Wiliam.
The Members then retired to consider the
application in private.
Sub-Committee decision –
The Chairman informed the meeting that having
considered the application and representations by Trading Standards
and interested parties and having considered the DCMS guidance, the
objectives of the Licensing Act 2003 and the Council’s statement of
the Licensing Policy, the sub-committee had:
RESOLVED – T H A T the amended application be
granted subject to the following conditions:
(1) Sale
of alcohol
08.00 hours to 21.30 hours Monday to Saturday
08.00 hours to 20.00 hours Sunday
(2) The
conditions set out in the applicant’s operating schedule together
with any mandatory conditions.
(3) It be
a condition of the license that all items of alcohol that are sold
be marked with an identifier, which should be notified to the
authority within 7 days of the license being granted.

(3) To
ensure that any alcohol that may be consumed by minors could be
traced back to the shop.
