openness of the area. The Group also expressed concern at the
unauthorised removal of trees from the site – in response to which
the Planning Officer confirmed that the matter was being
addressed.

ENFORCEMENT ACTION: LAND FORMING PART OF PANT WILKIN AND PWLL Y
DARREN FARMS, LLANQUIAN ROAD, ABERTHIN: UNAUTHORISED QUARRYING
OPERATIONS (DEER) -
The complaint received by the Local Planning
Authority in November 2006 alleging that major works of excavation
were ongoing on land to the immediate rear of the St. Hilary
Television Transmitting Station had been investigated. On
investigation, it had been observed that two distinct areas of the
land were actively in the process of being excavated to depths
varying between 2 metres and as deep as possible 7 metres. On
researching the planning history of the site, it was noted that a
recent September 2005 grant of consent had been issued for a larger
agricultural building, the implementation of which would have first
required the excavation of up to 7 metres of the ground to create a
level plane from which to build off. That approval was for a
building in the general area of the larger of the two current sites
of stone extraction operations. Also, the previous approval
had been issued under the Agricultural Prior Notification
application procedures in October 2001 for the removal of a
so-called high spot in the same field. However, it was
considered that the approval was not so obviously in the area of
the second of the two extraction operations.
It was, therefore, concluded that whilst
planning permissions and approvals had been issued for works which
either specifically consented to the removal and / or regarding of
material (the removal of a high spot) or by implication require the
removal of material before development could take place, the
proposed agricultural building, the operations observed were either
not in the area of those approvals or had fallen by virtue of the
rule of “condition precedence” wherein planning case law now
directed that where a condition required further details to be
submitted prior to commencement of development, and such details
had not been submitted, the Council could view the planning
permission as not having been implemented. In addition to the
above issues, however, it was further evident that the extraction
operations had gone well beyond the approved plans. In the
case of the lesser of the two extraction voids, whilst the
applicant subsequently claimed at a later site meeting that the PNA
approval covered those operations, it was evident that not only are
those estimated to extend some 100 metres beyond that approval and
over a much wider area, the submitted plans only indicated the
removal of a high spot of land and not any substantive excavations
into the ground. It was noted that during a recent site
inspection, that void was now being back-filled, possibly with
imported material.
Given the above, it was considered that the
works of excavation and back-filling were all unauthorised and the
pursuit of legal action was required.
RESOLVED - T H A T the Director of Legal,
Public Protection and Housing Services be authorised to take all
necessary action, including action under Section 172 of the Town
and Country Planning Act 1990, including, authority to issue a Stop
Notice if deemed necessary to ensure:
· the cessation of all stone
extraction / quarrying operations;
· the cessation of the
importation, depositing, stock piling and tipping of any form of
waste materials to include stone, soils, spoils, woods, metals,
plastics, hardcore, rubble and green wastes;
· the cessation of the
removal of any extracted stone materials off-site, including any
processed or crushed stone.
Reason for decision
In the opinion of the Local Planning
Authority, the extraction of stone and the back-filling of the
voids resulting from those operations cannot be justified for any
purposes of agriculture or forestry and, as such, is seen as being
contrary to Policies ENV1, ENV2 and ENV10 of the Vale of Glamorgan
Adopted Unitary Development Plan 1996 - 2011.

GENERAL PLANNING MATTERS: PROPOSAL TO CONFIRM A TREE PRESERVATION
ORDER: LAND EAST OF PEN-Y-LAN VILLAGE, COWBRIDGE (DEER) -
The report pertained to native deciduous trees
which together formed a copse growing on a steep escarpment and
spreading into lower land at the edge of a small paddock; also
included was a free standing mature Oak in the neighbouring
paddock. Concerns had been raised initially by a resident
that work was being carried out on the free standing Oak and a site
visit confirmed the importance of the trees to the visual amenity
of the area. The landowner had been informed that a Tree
Preservation Order was being considered and subsequently several
Ash trees were felled. A Tree Preservation Order was
subsequently served on the landowner and occupiers of the nearby
residential property notified. Since serving the TPO, a
further site meeting had taken place with the landowner present
where, for the purposes of the TPO, a boundary was set and
agreed.
RESOLVED - T H A T the Tree Preservation Order
referred to above be confirmed.
Reason for decision
To safeguard the future of the trees and the
visual amenity of the area.

Authority; the approved scheme of parking shall be laid out in
accordance with the approved details prior to the first beneficial
use of No. 5, Station Road and shall thereafter be so retained at
all times to serve the development hereby approved.

To ensure the provision on-site of
parking and turning facilities to serve the development in the
interests of highway safety, and to ensure compliance with the

GENERAL PLANNING MATTERS - NOTIFICATION UNDER SECTION 28(1) OF THE
WILDLIFE AND COUNTRYSIDE ACT 1981, AS SUBSTITUTED BY SCHEDULE 9 OF
THE COUNTRYSIDE AND RIGHTS OF WAY ACT 2000: BARRY WOODLANDS
SITE OF SPECIAL SCIENTIFIC INTEREST (DEER) -
Urgent by reason to keep
Committee informed
The Council had received notification
from the Countryside Council for Wales (CCW) that it was of the
opinion that the areas of woodland in the vicinity of Barry (Barry
Woodlands) were of special interest. The notification which
included woodlands to the north east of Barry (Pencoedtre Wood) had
been under consideration following the submission of an application
for outlying planning permission to develop Pencoedtre Wood for a
mix use of housing, business and woodland. This application
(04/017094/OUT) remained undetermined and would be subject to
further consideration by officers and this Committee in due
course. Whilst the report was for information purposes only
given that the above application remained undetermined, officers
had requested that the report be referred to Cabinet at its
earliest opportunity in order that representations on the
notification could be made and forwarded to the CCW in writing by
3rd August, 2007.
The Committee having regard to the
contents of the report
RECOMMENDED -
(1) T H A T the
correspondence dated 4th April, 2007 received from the
Countryside Council for Wales to identify Barry Woodlands as a Site
of Special Scientific Interest, be noted.
(2) T H A T the
report be referred to the next Cabinet meeting.

Committee informed.

informed and to enable a suitable response to be forwarded to the
Countryside Council for Wales by 3rd August, 2007.
