In response to concerns expressed in relation to the scheduling of the above meeting at the end of July, Members were notified that this would be the first opportunity to consider the draft report but that other opportunities would arise.  Notification of the meeting and of the content of the report had already been despatched in order to allow all Members of the Extended Group not only to acquaint themselves with the contents of the report but to diarise the date and time of the meeting.

247     ENFORCEMENT ACTION (DEER) -

 

(i)      Southmead, Llandow: Residential Static Caravans and Storage of the same

 

In September 2006 it had first been observed by the Enforcement Unit that a detached property located south of the Llandow Trading Estate and alongside the Vale of Glamorgan railway, had sited two static caravans within its grounds.  A complaint was subsequently received from a member of the public alleging that the caravans were in residential use.  It was subsequently observed that a further four static caravans had been sited on the land, (later increasing to five), to give a total of seven units. 

 

Two primary areas of concern surrounding this matter were:

 

(1)       the escalation of commercial activities at the site with storage of and apparent selling off of static caravans; and

 

(2)               what now appears to be the permanent siting and residential use of at least two of these units. 

 

Not only where both operations clearly subject to planning control in any event, but given the open countryside location of the property where the usual strong presumption against non-agricultural related development exists, both were viewed as unacceptable.

 

RESOLVED - T H A T the Director of Legal, Public Protection and Housing Services be authorised to serve an Enforcement Notice under Section 172 of the Town and Country Planning Act 1990 (as amended) to require:

 

(i)         the cessation of the use of the land for the purposes of parking, storing and siting of static caravans or mobile home type units and cease the use of any such units for the purposes of residential accommodation;

 

(ii)        the removal of all caravans and / or mobile homes from the land.

 

In the event of non-compliance with the Notice, authorisation be also granted to take such legal proceedings as may be required.

 

Reason for decision

 

The reason for the above decision was to prevent an unacceptable residential use of the land and also an extension of commercial / storage operations into the open countryside.

 

In the opinion of the Local Planning Authority, the unauthorised use of the land to store static caravans / mobile home type units, over and above that considered ancillary to the enjoyment of a dwelling house, and the use of some of these caravans for residential purposes, represented an unacceptable extension of both residential and commercial uses into the open countryside for which no justification could be made.  As such, the uses were considered contrary to Policies ENV1, ENV10, EMP2, EMP8, HOUS2 and HOUS5 of the Vale of Glamorgan Adopted Unitary Development Plan 1996-2011.

 

 

(ii)     Former Council Yard, East Sundown, Llandow (Highfield Farm): Unauthorised change of use of agricultural barn to commercial / business (Manufacture of stables and sheds)

 

In 2005, it was first suspected that a recently constructed, isolated agricultural barn, located near the Llandow Trading Estate and only approved under the Prior Notification Application procedure in August 2004, may be being used for another purpose, namely use by a landscape company.  Whilst this possible use appeared initially to be very intermittent, by late 2006 it had become apparent that the company occupying were in fact manufacturing stables, sheds, field shelters and suchlike.  This was subsequently confirmed by the operating company.

 

Since alerting the landlord to the Council’s findings and intended stance in this matter, he had verbally replied that the offending company had been given six weeks notice to quit (as of 1st July).  However, in anticipation of this deadline not being met, and having noted that the farm holding (Highfield Farm) already had a recent history of unauthorised commercial operations, authorisation to pursue enforcement action was still requested.

 

RESOLVED - T H A T the Director of Legal, Public Protection and Housing Services be authorised to serve an Enforcement Notice under Section 172 of the Town and Country Planning Act 1990 (as amended) to require:

 

(i)      the cessation of the use of the agricultural barn building and surrounding yard area for any manufacture, storage and distribution purposes, including any use considered to fall within Use Classes B2 and B8 of the Town and Country Planning (Use Classes) Order 1987.

 

In the even of non-compliance with the Notice, authorisation was granted for any such legal proceedings as may be required.

 

Reason for decision

 

In the opinion of the Local Planning Authority, the use of the agricultural barn building only approved under the Prior Notification Application procedures in August 2004, for commercial manufacture, storage and distribution purposes not related to agriculture, is not only viewed as a serious abuse of the planning system, but one which is also contrary to Strategic Policy 5, and Policies ENV1, ENV8, EMP1, EMP2 and EMP7 of the Vale of Glamorgan Adopted Unitary Development Plan 1996-2011.

 

 

248     GENERAL PLANNING MATTERS (DEER) -

 

(i)      Vale of Glamorgan Local Development Plan (LDP): Candidate Site Register and Assessment Methodology

 

Members’ approval was sought for the publication of the Vale of Glamorgan Local Development Plan candidate site register, and to endorse the proposed candidate site methodology. 

 

A report had been considered by Cabinet and Scrutiny Committee on 20th June, 2007 which provided background information on the candidate site process and the preparation of a candidate site register.  In addition, the report set out the Council’s proposed methodology for assessing the suitability of candidate sites against the LDP Strategy and the Sustainability Appraisal Framework. 

 

Cabinet had resolved that subject to consideration of the views of the Planning Committee and the Scrutiny Committee (Economy and Environment):

 

(1)       The availability of the initial candidate site register be noted and be endorsed for public release.

 

(2)       The methodology and criteria for the future assessment of candidate sites as detailed in the report be endorsed.

 

(3)       That a further report on the results of the candidate site assessment process be reported
