The representative from Dinas Powys Community Council advised the Group that the Community Council had been concerned about the design of the application and the height was not acceptable. The flat roof design was also not very sympathetic to the conservation area.

 

RECOMMENDED - REFUSAL, the Group considered the current proposal would neither preserve nor enhance the character and appearance of the conservation area especially with regard to scale and design of the building at the front of the site projecting onto Station Road and requested that officers be advised to consult with the applicant and bring further amendments to the Committee if appropriate.

Having considered the application and the plans the Committee felt that the plans did not represent the finished development and they were concerned that the proposal represented an overdevelopment of the site, the lack of amenity space and that the general design could in their opinion be improved upon.

 

RECOMMENDED - REFUSAL, the Group felt that the application should be refused on the grounds that the form, scale and design of the application were inappropriate and would not preserve or enhance the character of the conservation area.

 

(e) Conservation Area Management in the Vale of Glamorgan (DEER) -

 

At a previous meeting of the Conservation Group in November 2006 the Group had been advised that consultants (Conservation Studio) had been appointed by the Council with the objectives to:

  •  review the scope and content of the Council’s conservation areas
  •  critically apprise the Council’s internal structures, processes and attitudes to managing conservation area legislation.

At the meeting in November it had also been recommended that a further meeting would need to be arranged to consider the final report by the consultants. The submission of the annual report by consultants into conservation area management in the Vale of Glamorgan (Valuing Distinctive Places) had been circulated to Members of the Group in advance of the meeting by means of a letter dated 22nd June, 2007 and a CD rom. The report had also been presented to the Council’s Cabinet on 20th June, 2007 in order to progress the findings of the report. The report that had been presented to the Cabinet was attached at Appendix A. It was noted that the final report of the consultants included details of a series of interviews with key officers and Members of the Council and a benchmarking exercise had been undertaken with five other authorities in Wales (Bridgend County Borough Council, Ceridigion County Council, Flintshire County Council, Monmouthshire County Council and Pembrokeshire National Park). The report had also been considered by the Council’s Planning Committee on 19th July, 2007. The specific references to the Conservation Area Advisory Group were contained in Paragraphs 10-16 of the report to Cabinet and it was on the basis of the report and perceptions of the future role of the Group that the Council wished to stimulate debate at the Conservation Advisory Group meeting. In particular the following themes were considered to be helpful for Members to focus their discussion:

 

(a) “Reactive Agenda” (Commenting on Planning Applications)

 

(i) What is the perceived value and outcomes of the Group’s input to applications for development?

 

(ii) Should the agenda be further reduced to relate to the consideration of major applications, and if so, what criteria for selection might be considered?

 

(iii) Should the agenda be retained in favour of consideration of the range of proposals as at present, and do the criteria operate satisfactorily?

 

(b) The Strategic Outlook

 

(i) If the Group were to engage in greater involvement in policy formulation, what issues would it consider to be important (examples: County Treasures and local listing, design awards, Local Development Plan, Conservation Area Appraisals, Supplementary Planning Guidance)?

 

(ii) Should the remit of the Group be balanced in favour of wider policy issues relating to the historic built environment as a forum, in distinction to the reactive agenda as in (a) above?

 

(c) Constitution and membership

 

(i) Does the Group have the right number of Members, and what might be done to improve fluctuating / low levels of attendance?

 

(ii) How far should the Group be balanced in Membership to reflect wider, strategic interests, e.g. by the addition of new, specialist Members?

 

(iii) How frequently should policy issues be a subject on the agenda?

 

(iv) In conjunction with (c)(iii) above, is there a need for further training of Members to increase awareness of certain issues, and if so, what issues?

 

(v) How should the Group create new agendas given an ongoing, identified shortage of resources available to the Council to service its needs?

 

The Group was informed that following discussions concerning the content of the study, a further report was to be made to the Council’s Cabinet regarding the management implications of the consultant’s report. Members of the Conservation Area Advisory Group were also encouraged to put on record their views on the study, which would in turn be reported back to the Council’s Cabinet. The report had highlighted that the Conservation Advisory Group of the Vale of Glamorgan was an under-utilised resource and Emma Harvey, Operational Manager for Planning and Transportation Policy opened the debate by asking the Committee “how do you think the Group should work in the future”. Members of the Committee raised a number of points during the discussion as detailed below:

  •  Terms of Reference to be amended in light of the consultant’s report
  •  That training be arranged for those Members wishing to seek advice in respect of conservation matters
  •  That the agendas remain the same but include policy matters
  •  That policy issues be reported to the Committee in advance, in order that the views of the Committee can be sought and recorded before the Council’s final policy was approved
  •  The difference between preservation and conservation matters be highlighted for the Committee
  •  Further training on dealing with planning applications and enforcement matters be provided to the Committee.

The Group welcomed the report and the view that the Conservation Advisory Group was under-utilised and should have a further role in conservation area matters within the Vale of Glamorgan Council. The Group considered itself a valuable resource with a number of professional and amateur members and it welcomed the role of looking at documents / areas in a strategic manner to have an impact on the policy of the Council. Members also raised the issue of conservation area appraisals and noted that there had been some changes to some conservation areas as a result of the consultant’s report but were advised by the Operational Manager, Emma Harvey, that no detailed conservation area appraisals had yet been undertaken. These were envisaged for the future and the consultant had only been asked to provide a brief overview at this stage.

 

RECOMMENDED -

 

(1) T H A T the contents and conclusions of the report into conservation area management in the Vale of Glamorgan (Valuing Distinctive Places) be noted.

 

(2) T H A T a further report be submitted to a future extended meeting of the Group to present options relating to the future constitution, form and agenda of the Group in the light of the consultant’s findings.

 

(3) T H A T the minutes of this meeting be forwarded to all Members of the extended Group as soon as possible in order that they can consider the discussions that had been held and make any written representations or offer further views on the report to Emma Harvey, Operational Manager, Docks Office, Subway Road, Barry, or e-mail ELHarvey@valeofglamorgan.gov.uk by no later than 1st October, 2007.

307   ENFORCEMENT ACTION (DEER) -

 

(i) 12 Wayside Cottage, Cardiff Road, Dinas Powys: Unauthorised Vehicular Access

 

In February 2007 a complaint was received that a new vehicular access had been created onto the main A4055, Dinas Powys to Cardiff/Penarth Road, to serve the above property. Having informed the landlord in writing that the access was not only subject to planning control but was also considered wholly unacceptable, parking on-site had not been observed since. Despite instructions to reinstate some form of front boundary treatment to block the access, thus preventing its use, no such barrier had been erected. The main issue in the case was the creation of vehicular access onto a major heavily trafficked highway wherein not only had no proper facilities been provided in terms of drop kerbs or cross-over, but any vehicle using the facility would require some form of blind reversing movement to either exit or enter the site.

 

RESOLVED - T H A T the Director of Legal, Public Protection and Housing Services be authorised to serve an Enforcement Notice under Section 172 of the Town and Country Planning Act 1990 (as amended) to require the cessation of the use of the unauthorised vehicular access and the construction of a one metre high boundary wall or fence along the frontage of the site, and that authority be granted to take appropriate legal proceedings in the event of non-compliance with the Notice.

 

Reason for decision

 

The unauthorised vehicular access cannot make provision for adequate vision splays or on-site turning facilities to allow safe vehicular access and egress in a forward gear. The development therefore represents a hazard to highway safety and the free flow of traffic on the adjoining heavily trafficked A4055 Cardiff Road.

 

308   GENERAL PLANNING MATTERS (DEER) -

 

(i) Romilly Park Road, Barry: Amendments to Existing Traffic Regulation Order -

 

In view of the proposed change of use of No. 76 Romilly Park Road from a residential property to a children’s nursery, it was considered necessary to amend the existing Traffic Regulation Order, the effect of which was to prohibit waiting from 9.00am to 9.00pm daily between 1st April to 30th September annually to a full no waiting at any time Order effective twelve months of the year. That amendment would allow adequate kerbside parking capacity to be provided for the dropping off and picking up of children attending the proposed nursery. The details of the proposals were appended to the report.

 

RESOLVED -

 

(1)  T H A T, subject to the views of the Chief Constable and other representatives of road users, public notice of the Council’s intentions to make a Traffic Regulation Order under the Road Traffic Act 1984, the effect of which would be as set out in the schedule appended to the report.

 

(2)  T H A T, in the event of no objections being received, the Order be made, that costs for implementation be obtained from the developer and that the works be undertaken.

(ii) Various Roads, Llandough: Prohibition of Waiting Order -

 

Authority was sought to introduce a Traffic Regulation Order to prohibit the waiting of vehicles between 8.00am and 6.00pm on Mondays to Fridays inclusive along sections of Dochdwy Road, Pantycelyn Road, Waverley Close, Grassmere Close, Greenhaven Rise and Uplands Crescent, Llandough. It was noted that, currently, the unrestricted section of Dochdwy Road between its junctions with Penlan Road and Pantycelyn Road was subject, throughout the working day, to high levels of parking by employees attending the nearby Hospital site. Parked vehicles regularly obstructed the two way flow of traffic along the spine road and created a potential road safety hazard for parents and pupils attending the local primary school. It was considered that, in the interests of highway safety and to assist traffic flow, that extraneous parking should be discouraged by the introduction of a prohibition of waiting between the hours of 8.00am and 6.00pm on Mondays to Fridays inclusive. In anticipation that one effect of introducing such waiting restrictions would be to displace such extraneous parking to other parts of the residential estate, it was suggested that the restrictions extend along Dochdwy Road, to a point south of its junction with Greenhaven Rise, include other junctions along the spine road and include a section of Pantycelyn Road south of its junction with Dochdwy Road. The extent of the proposals set out above was appended to the report.

 

RESOLVED -

 

(1)  T H A T public notice be given of the Council’s intention to make an Order under Section 1 of the Road Traffic Regulation Act 1984, the effect of which was described in the schedule and plan appended to the report.

(iii) St. Andrews Major Church in Wales Primary School, St. Andrews Road (Part) and Britway Road, Dinas Powys: 20m.p.h. Zone Order -

 

Authority was sought to introduce a 20m.p.h. speed restriction Order with associated traffic calming measures over St. Andrews Road (part) and Britway Road, Dinas Powys as part of an approved Safe Routes to Schools scheme funded by the WAG. It was reported that there had been four road traffic collisions involving personal injury from 1st January, 2002 to 31st December, 2006 although no pedestrians had been involved. Traffic surveys undertaken on St. Andrews Road over a five day period had indicated a majority of speeds for both westbound and eastbound traffic to be 35m.p.h. (or over) with well over 2,000 vehicles utilising the road within a 24 hour period. Both St. Andrews Road and Britway Road were very narrow carriageways with only one footway on the southern side of Britway Road. The prevalence of on-street parking was such as to reduce the carriageway to a single lane and to reduce visibility for pedestrians - particularly children crossing the road to access the Common. As a legal requirement, when introducing 20m.p.h. zones and to ensure compliance with the proposed speed restriction, a traffic calming scheme consisting of a series of speed cushions and single raised zebra crossing adjacent to the eastern entrance to the primary school would be implemented. Details of the proposals were appended to the report.

 

RESOLVED -

 

(1)  T H A T public notice be given of the Council’s intention to introduce a 20m.p.h. zone, the effect of which would be as shown in the schedule appended to a report, and to construct a series of speed cushions and a raised zebra crossing as shown in the second schedule appended to the report.

20. Notwithstanding the terms of the Town and Country Planning (General Permitted Development) Order 1995 or any Order amending, revoking or re-enacting that Order howsoever, access to the site shall be as detailed in the approved drawings and no additional or alternative means of access to the public highway shall be created without the formal consent of the Local Planning Authority.

21.
