434 DELEGATED POWERS
FOR PLANNING OBLIGATIONS CONTAINED WITHIN SECTION 106 LEGAL
AGREEMENTS (REF) -
Consideration was given by Cabinet, on
19th September, 2007 to extending the existing system of
delegated powers to the determination of planning applications
which were subject to Section 106 Legal Agreements but only for
those planning applications that would normally be determined by
the Director of Environmental and Economic Regeneration / Head of
Planning and Transportation under the existing scheme of officer
delegation. Approval was also sought to delegate powers to
spend monies received through planning obligations contained within
Section 106 Legal Agreements in accordance with the provisions of
the Legal Agreement as agreed by the Planning Committee in
consultation with the Director of Finance, ICT and Property, the
relevant service areas, the local Ward Member(s) and the relevant
Cabinet Member. By way of background it was explained that
the Council had the power to enter into Legal Agreements with
developers under Section 106 of the Town and Country Planning Act
1990 to seek contributions from developers to mitigate negative
development impacts and facilitate development which might not
otherwise occur, and that the Council had recently appointed a
Section 106 officer to co-ordinate the seeking, implementing and
monitoring of such Agreements in consultation with the relevant
service areas. It was noted that the current scheme of
delegation for planning applications enabled the Director / Head of
Planning and Transportation to determine relatively minor planning
applications but was currently silent on applications of that
nature which were subject to Section 106 Legal Agreements. It
was also noted that, in terms of implementation and monitoring,
there was no current established protocol for the spending of
monies received through planning obligations and no database had
been maintained to record this information.
The use of delegated powers for determining
planning applications was recognised as good practice throughout
Local Authorities as a way of speeding up the decision making
process and removing bureaucracy for relatively minor planning
applications. “Speed” was one of the aims of the
planning obligations service standards and it was, therefore,
crucial that where applications were relatively minor in nature
they should not be unduly delayed because of the need for a legal
agreement. It was further proposed that once the Section 106
monies were received, a process be introduced for those monies to
be spent in accordance with the terms of the legal agreement
without the need for a further report to Cabinet. A flow
chart indicating the proposed process was appended to the
report. The procedure was considered necessary to reduce the
workload burden upon service areas, to improve efficiency in the
implementation of planning obligations, to ensure consistency
across the Council in terms of the implementation of planning
obligations and to ensure transparency for all interested
persons. A planning obligations database had now been
established and an annual report would be prepared to inform both
the Cabinet and the Planning Committee about progress on the
implementation of planning obligations.
Cabinet had resolved that, subject to
consultation with the Planning Committee,

the current scheme of delegation be amended to include all
applications which were subject to a Section 106 Legal Agreement
(or unilateral undertaking) where those applications would
ordinarily be determined under delegated powers by virtue of the
type of application
·
that monies received through planning obligations contained within
Section 106 Legal Agreements be spent in accordance with the terms
of the Legal Agreement and authorised by the Head of Planning and
Transportation and / or Director of Environmental and Economic
Regeneration in consultation with the Director of Finance, ICT and
Property, Cabinet Member for Finance, ICT and Property, the
relevant service areas and the local Ward Member(s).
Reasons for decision
To allow for improved efficiency in the
progression of minor applications which are subject to Section 106
Legal Agreements and to enable the efficient and effective
implementation of planning obligations and to avoid the duplication
of workload and reporting.

440 GENERAL PLANNING
MATTERS (DEER) -
(i) Welsh Assembly
Government Consultation: Technical Advice Note 17: Planning and
Managing Development
Planning Committee were advised of the
publication in August 2007 of draft Technical Advice Note 17
entitled Planning and Managing Development. Endorsement was
also sought of a response to the draft Technical Advice Note so
that it could be issued to the Welsh Assembly Government by
30th November, 2007.
The Council’s suggested response to the
questions asked (29 in total) was contained within Appendix A to
the report. In addition there were additional general issues
that needed to be considered when responding to WAG.
The principle of producing advice or
information on the Development Control function was welcomed.
Indeed it was considered that there was a need to produce
“centrally” at national level a user friendly reference point on
all aspects relating to the development control function.
However, it was felt that the role of
Technical Advice Notes was to provide guidance on the
interpretation of WAG policy on various aspects of land use
planning. The draft TAN 17 did not achieve this, and the
information related more to the function of the Development Control
service. In this regard, whilst some of the information would
be relevant to various stakeholders, the information, following
modification and streamlining would be better conveyed through a
more general “user advice booklet”.
A great deal of the information provided was
detailed and related to processes and procedures which it was felt
would be best delivered directly to the Planning Delivery for Wales
programme as opposed through a TAN.
In this regard and in addition, it was a
matter for local planning authorities to organise how to manage the
development control function, and not the WAG through the
production of a TAN. If WAG was minded to involve itself in
providing examples of how local planning authorities should
implement “Development Control” then this should not be through a
TAN but through the Planning Delivery for Wales initiative
generally, with a series of good or best practice case
studies.
In addition, elements of the documents were
considered to be weak in providing advice for the provision of
advice which, with respect to the WAG, was quite simply common
sense. By way of example:
·
The majority of the document was a “stock take” of what was
Development Control and provided no real advice on best
practice. In this regard examples of good practice and case
studies may well be appropriate, but not through a TAN.
·
The advice given in Section 3.1 on deciding planning applications
was common sense and was laid out in statute.
·
Likewise the advice given on the management of teams leading and
the need for communication between officers and managers was common
sense and was generally accepted.
·
Advice in 3.12.2 was incorrect as there was no legislative duty for
planning applications have to be submitted on the relevant local
planning authority’s form.
·
Seeking feedback on options for the handling of local planning
authorities applications through this draft TAN (Section 3.18) was
totally unacceptable and inappropriate. If the handling of
their own applications by local planning authorities was an issue
for WAG, then separate free-standing consultation should be
undertaken on this issue. WAG should also provide evidence as
to why there was concern on this issue.
·
Whilst the document touched on the difficult issue of
post-application changes, condition precedent and amendments, no
constructive advice was offered. Indeed, the advice given was
erroneous as for example, on post decision changes the suggestion
was that the process to be employed may vary depending on the
degree of changes and the options given through the draft TAN had
no basis in statute. Again, this was a matter that this
Council had raised previously and it was interesting that in
England, the Government was looking to provide a “statutory base or
footing” for the formal consideration of amendments. At
present, it does not appear that there are no such proposals for
Wales.
Given the nature of the above comments and the
shortcomings of the draft TAN, it was recommended that the report
be also issued to WAG, in addition to the responses as set out in
Appendix A to the report.
RESOLVED - T H A T a copy of the report and
the responses to questions as drafted in Appendix A to the report
be issued to the Welsh Assembly Government as the Council’s
response to the draft Technical Advice Note 17: Planning and
Managing Development.

To allow the Council to respond to the Welsh
Assembly Government on the draft Technical Advice Note prior to
30th November, 2007.
(ii)
Welsh Assembly Government Consultation On Lifting The Planning
Barriers To Domestic Energy Micro-Generation; Proposed Changes To
Permitted Development Rights -
Planning Committee were advised of the above
consultation document, issued on 9th August, 2007 and
were asked to endorse the response to the consultation by
14th November, 2007.
The consultation paper dealt with various
forms of domestic micro-generation techniques in turn, and posed a
series of questions. Annexes 1, 2 and 3 of that paper were
copied and attached as Appendix A to the report.
Annex 1 was a summary of the proposed
permitted development rights, recommended in the consultation
document and in respect of which responses to questions were
sought.
Annex 2 detailed WAG’s thinking in respect of
noise and vibration measurements as they related to permitted
development rights.
Annex 3 was the suggested draft of the
amendment to the General Permitted Development Order.
In addition, at Appendix B to the report was a
list of the questions asked and suggested responses for
consideration by Committee.
Proposals were made to classify as permitted
development installations relating to:
·
Solar panels on walls, roofs and freestanding within gardens of
properties subject to certain limitations.
·
Ground source and air source heat pumps, again subject to
limitations in respect of noise.
·
Wind turbines both on buildings and free standing, again with
limitations specifically on noise and height / size of
turbines.
·
Biomass and combined heat and power installations.
In responding, in addition to the detailed
comments at Appendix B to the report, the following points were
considered to be particularly relevant:
(i) The general
approach and classifications were accepted albeit with some caveats
and not insignificant concerns.
(ii)
There was concern that the proposal to allow 100% roof and wall
coverage on solar panels as such extensive coverage could well
impact negatively on the appearance of buildings.
(iii)
There was concern at the use of the limitation “visible from a
highway” for several reasons. In particular, such a
limitation could be unduly restrictive and actually restrict
developments that could have very little impact (e.g. when the
installation was set well back from the highway). In
addition, and in terms of workability, the assessment of whether
the installation would be “visible from the highway” would require
a site visit to assess whether a proposal was in fact permitted
development. This would be resource intensive. Finally,
after the implementation of the development under Permitted
Development Rights, the local planning authority was as likely to
receive claims from objectors or concerned residents that the
installation may well be visible from a highway. The use of
such a vague description was therefore considered to be
inappropriate both in terms of the assessment required and the
likely “enforcement fallout” as a consequence of its
implementation.
(iv) The
noise limitations proposed for turbines and heat pumps were
extremely complex and again unhelpful. In this regard far
from allowing the provision of a straightforward and clear
permitted development Class, the use of the limitations proposed
resulted in an extremely complex, unclear and potentially
bureaucratic system for determining whether micro-generation was
permitted.
In general therefore, it was felt that whilst
the principle of providing a new Class 40 was supported and
welcomed, further work was necessary to ensure that the system was
as clear and straightforward as possible.
RESOLVED -

(iii) Open
For Business: The Development Team Approach -
Endorsement was sought of a document entitled
“Open for Business - The Development Team Approach” as attached at
Appendix A to the report.
It had been recognised that bringing together
representatives from different Council service areas at an early
stage in the development planning process could bring major
benefits to all parties.
The approach was not new and had been used
frequently on major development proposals, with recent examples
relating to the DTR St. Athan project, Barry Waterfront as well as
more local schemes relating to historic buildings.
Although the approach was not new, it had not
until now been documented. The purpose of the report before
Committee was to seek endorsement of the document attached at the
report which sought to define the Development Team Approach and to
encourage its use by the Developers and Councils. It also
sought to provide a framework for implementing the Development Team
Approach by providing contact names within the Planning and
Transportation Division of the Council.
RESOLVED - T H A T the “Open for Business -
The Development Team Approach” document attached at Appendix A to
the report be endorsed.
Reason for decision
To endorse the Development Team Approach to
ensure its consistent use by the Council when considering major
development proposals.
(iv)
Listed Building Condition Survey: Listed Buildings at Risk -
The endorsement of Planning Committee was
sought in relation to a report which had been submitted to Cabinet
on 3rd October, 2007.
Cabinet had RESOLVED:
(1) That,
subject to consultation with the Planning Committee, the proposed
methodology of reviewing individual cases, prioritised and informed
by the findings of the Buildings at Risk Survey, be endorsed.
(2) That
the requirement for formal action under the terms of legislation be
considered by the Planning Committee on a case by case basis, with
reports to include a consideration of the likely financial
implications, liabilities and options inherent in the service of
such Notices on each of the individual buildings concerned.
Having considered the contents of the report
entitled “Listed Building Condition Survey - Listed Buildings at
Risk” together with the decisions of Cabinet, it was
RESOLVED - T H A T the content of the report
together with the decision of the Cabinet be endorsed.
Reason for decision
To advise Cabinet of the Planning Committee’s
stance in this matter.
(v)
Planning Application Validation Procedures And Procedures Relating
To Pre-Application Advice -
Endorsement was sought of a new
pre-application validation procedure and pre-application advice
procedure.
The speed of determination of applications for
planning and other forms of permission was an important national
measure of the efficiency of local authorities. In this
regard, there were accepted requirements that applicants should
meet in submitting applications. A procedure note was
attached at Appendix A to the report, the purpose of which was to
set out the Council’s requirements for applicants. The
procedure note leaned heavily on the guidance issued in 2005 by the
Office of the Deputy Prime Minister and draft Guidance issued in
August 2007 by the Department for Communities and Local
Government. Both these Guidance Notes advocated the
production of local guidance by individual authorities on their own
specific requests from applicants.
It was hoped that the provision of a local or
bespoke Guidance Note for the Vale of Glamorgan would clarify the
Council’s requirements of applicants and promote a greater
understanding as to why these requirements were in force.
The same proposals applied to the procedure
note attached at Appendix B to the report in that it sought to
provide clarity and consistency for dealing with requests for
pre-application advice, and at Appendix C in relation to permitted
development enquiries.
With reference to pre-application advice, the
focus was very much on establishing “minimum standards of service”
which prospective developers could expect from the Council and
which the Council should also expect from those seeking
advice.
RESOLVED -

Planning Committee were advised of the Access
and Design Statement Leaflet.
From 30th June, 2007 Access and
Design Statements had been required under Article 4D of the Town
and Country Planning (General Development Procedure) Order 1995,
and Regulation 3B of the Planning (Listed Buildings and
Conservation Areas) Regulations 1990, as inserted by the Town and
Country Planning (General Development Procedures) (Amendment)
(Wales) Order 2006 (SI 2006/3390 W.310), and the Planning (Listed
Buildings and Conservation Areas) (Amendments) (Wales) Regulations
2006 (SI 2006/3316 W.301).
If an application was submitted for any
development other than a household extension or a straightforward
chang
