(b) General –
Trefnant, Penyturnpike Road, Dinas Powys –
Committee considered a proposal to fell six
young trees: 2 (Wych) Elms; an Ash, an Oak, an Alder and a
Juniper all ranged around the edge of a swimming pool close to the
north boundary of the garden. The whole garden was covered by
Tree Preservation Order (No. 2), 1954 which had been confirmed on
5th July, 1955.
None of the trees were mature and all but one
were located in confined areas around the swimming pool. For
example, the Elm and Ash were in small raised beds and whilst the
former tree was clearly dying, the Ash, if left, could undoubtedly
cause problems with a retaining wall. There was evidence that
patching up with cement had already been carried out. Given
the location to the site of the swimming pool and the risks of
summer branch drop associated with a mature Ash, this was not an
ideal specimen. The Oak, Alder and Juniper were positioned
close to a gravel footpath. Again, the Oak and the Alder had
the capacity to grow much larger and the Oak had a long life
expectancy. On this basis, it seemed likely that some of the
trees had suffered due to root severance perhaps during the time
the swimming pool and paths were constructed and although young
trees could recover, their proximity to structures and their size
potential were already causing concern. It was considered
that the trees were inappropriately sited and their felling should
be seen as an opportunity for new planting smaller native
ornamental trees like Crab Apple, Rowan or Wild Cherry.
The larger free-standing Elm which was closer
to the interior of the garden was also dying (as Elms commonly do
these days once they reach a certain size, being unable withstand
attacks by Dutch Elm) and it was recommended that it be replaced
with a Field Maple.
RESOLVED – T H A T the application be approved
subject to the following conditions:
1. The work shall
be carried out in accordance with accepted rules and practices of
good tree surgery to conform to B.S. 3998 – Recommendations for
Tree Work.
Reason:
To ensure the work is carried out to an acceptable standard.
2. The work hereby
approved shall be carried out within twelve months of the date of
this consent.
Reason:
To ensure the work is completed within a reasonable time limit.
3. A scheme of tree
planting of a size and species to be agreed shall replace those
around the swimming pool area although they can be planted
elsewhere in the rear garden and one Field Maple of extra heavy
standard size shall be planted to replace the larger Elm, southwest
of the swimming pool. These replacement trees shall be
planted in a dormant state between October 2008 and March 2009 and
must be properly staked and watered during periods of drought and
shall be so maintained for a period of five years. In the
event of any tree dying or becoming diseased it shall be replaced
with a similar size tree.
Reason:
To ensure that the visual amenities of the area are protected and
to encourage biodiversity.

924 GENERAL PLANNING
MATTERS (DEER) –
(i) Future Format
and Constitution of Conservation Area Advisory Group –
Planning Committee were requested to

give consideration to the future role of the Council’s Conservation
Area Advisory Group and its management
·
progress recommendations from the report made to Cabinet of
5th March, 2008 (a copy of which was attached at
Appendix A to the report).
The relevant issues and options were as
contained in the background report attached at Appendix B to the
report. The Council’s position and objectives in running the
Group were as described in paragraphs 17/18. Paragraph 19
discussed the creation of a “Forum” in distinction to the
current Group organisation, which may have the following key
characteristics:

smaller size
·
wider agenda
·
improved strategic outlook
·
altered membership
·
greater independency.
Also attached as Appendix C to the report were
three consultation responses received from Members of the
Conservation Area Advisory Group in response to issues raised at
the extended meeting of 27th July, 2007.

Conservation Area Advisory Group (Extended Meeting) of
16th April, 2008.

Mount Road, Dinas Powys: Proposed 30 mph Speed Restriction Order
–
Approval was sought for the introduction of a
Traffic Regulation Order to create a speed restriction of 30 mph
over the length of Mount Road, Dinas Powys from its junction with
Station Road to its junction with St. Andrew’s Road, a distance of
approximately 400 meters.
The Council had introduced a 20 mph speed zone
over the length of St. Andrews’s Road and Britway Road, Dinas Powys
as part of a “safe routes to school” scheme. This had
included a sign indicating a 30 mph speed limit for Mount
Road. However, Mount Road did not have a system of street
lighting, consequently it required a Traffic Order to implement
this restriction.
The village of Dinas Powys was generally
subject to a 30 mph speed restriction with a 20 mph restriction
outside the school. However, Mount Road as considered in the
report was currently subject to the national speed limit of 60 mph
with no footway or street lighting. A number of residential
properties were situated along its length, and pedestrians had to
walk in the carriageway, including children travelling to and from
St. Andrew’s Major Church in Wales School.
The local Members and the Chief Constable had
been consulted and their responses were awaited.

T public notice be given of the Council’s intention to make an
Order under Sections 81, 82, 83 and 84 of the Road Traffic
Regulation Act 1984, as set out at Appendix A to the report.

4. The new windows
within the South West facing elevation at both ground and first
floor levels shall be of fixed pane construction and obscurely
glazed at the time of construction and shall be so maintained at
all times thereafter. Details of any high level windows that may be
required to be openable for ventilation shall be submitted to and
agreed in writing by the Local Planning Authority prior to their
insertion.

To protect the privacy of those within the adjacent property and to
ensure compliance with Policies ENV27 and HOUS8 of the Unitary

floor windows contained within the north west facing elevation
shall be obscurely glazed at the time of their insertion and so
