Tacit Consent
Yes. This means that you will be able to act
as though your application is granted if you have not heard from
the local authority by the end of the target completion period.
The target time is 37 calendar days.
What is tacit authorisation?
The EU Services Directive requires that all
licence applications, authorisations and administrative procedures
applicable to service providers (such as Vale of Glamorgan Council)
must be processed as quickly as possible and, in any event within a
reasonable time period, which is fixed and made public in
advance.
Where tacit authorisation applies it will be
stated with the set timescale that approval or refusal must be
given by the Council to you, the applicant.
When a response to an application does not
occur within the set time period or following an extension, the
authorisation may be deemed to have been granted tacitly if the
consent applies.
Where tacit authorisation does not apply it
will be stated with the set timescale that the Authority aims for
approval or refusal but the application will not be deemed as
granted if decision has yet to be determined.
However, please note that the tacit
authorisation process only starts once a correctly completed
application has been received, and where applicable, is accompanied
with any additional relevant or requested documentation to support
the application.
