EARLY RETIREMENT / REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 24th April, 2017.

 

Present:  Councillor S.C. Egan (Chairman); Councillors G. John, Mrs. A. Moore and A.P. Riley.

 

 

1013   APOLOGIES FOR ABSENCE -

 

These were received from Councillors Ms. B.E. Brooks (Vice-Chairman), H.J.W. James and Mrs. M. Kelly Owen.

 

 

1014   MINUTES -

 

RESOLVED - T H A T the minutes of the meeting held on 27th March, 2017 be approved as a correct record.

 

 

1015   DECLARATIONS OF INTEREST -

 

No declarations were received.

 

 

1016   EXCLUSION OF PRESS AND PUBLIC -

 

RESOLVED - T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.

 

 

1017   DETERMINATION OF REDUNDANCY - M (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) (MD) -

 

Consideration was given to the proposed redundancy in respect of one employee within the Managing Director and Resources Directorate.

 

RESOLVED -

 

(1)       T H A T a redundancy payment be approved with effect from 31st July, 2017, on the basis of Scheme D of the Council’s Early Retirement / Redundancy Scheme subject to Resolution (2) below and M complying with the Council’s Avoiding Redundancy Procedure.

 

(2)       T H A T should alternative employment be found for M, that the notice be extended to cover any trial period as necessary and Resolution (1) be revoked together with the statutory redundancy payment should the trial period prove successful.

 

Reasons for decisions

 

(1)       To support the implementation of the amendments to the Council’s establishment.

 

(2)       To support the Council in achieving the financial efficiencies and organisational changes to maintain sustainable service delivery.

 

 

1018   APPLICATION FOR FLEXIBLE RETIREMENT - M (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) (DLS) -

 

Consideration was given to an application for flexible retirement in respect of one employee within the Directorate of Learning and Skills.

 

RESOLVED -

 

(1)       T H A T the flexible retirement of M be approved in accordance with the Council’s Policy subject to no other circumstances arising in the interim whereby the employment were to be terminated for a different reason.

 

(2)       T H A T the use of the appropriate officer delegated powers be endorsed, to enable M to reduce their contracted hours from 37 hours to 15 hours per week from week commencing 1st August, 2017, with the retirement of M from the employment with the Council taking place on or before 30th April, 2018.

 

Reasons for decisions

 

(1)       To determine the flexible retirement application within the Regulations and to allow for eventualities that may not be known at this time.

 

(2)       To achieve the necessary change to the employee’s working hours, to support the employee’s request for flexible retirement whilst also securing the employee’s continued employment for a period of one year during which the employee’s skills will be critical to the completion of service developments.

 

 

1019   DETERMINATION OF REDUNDANCY / EARLY RETIREMENT - B, D, J, K, N, R AND T (EXEMPT INFORMATION - PARAGRAPHS 12, 13 AND 14) (DSS) -

 

Consideration was given to applications for early retirement on the grounds of redundancy in respect of the above employees within the Social Services Directorate.

 

 

RESOLVED -

 

(1)       T H A T a statutory redundancy payment be approved in respect of T on the basis of Scheme D of the Council’s Discretionary Redundancy Policy and within the statutory financial parameters as set out in Appendix B to the report, subject to no suitable alternative employment arising prior to the date of termination and to Resolution (4) below.

 

(2)       T H A T a statutory redundancy payment be approved in respect of N and R on the basis of Scheme D of the Council’s Discretionary Redundancy Policy and within the financial parameters as set out in Appendix B to the report, subject to no suitable alternative employment arising prior to the date of termination and to subject to Resolution (4) below.

 

(3)       T H A T a discretionary redundancy payment be approved in respect of K, J, D and B in accordance with Scheme E of the Council’s Discretionary Redundancy Policy and within the financial parameters set out in Appendix B to the report, subject to no suitable alternative employment arising prior to the date of termination and subject to Resolution (4) below.

 

(4)       T H A T should alternative employment be found for the above employees that the notice be extended to cover any trial period if necessary and Resolutions (1), (2) and (3) be revoked together with the redundancy payments should the trial period(s) prove successful.

 

Reasons for decisions

 

(1,2&3)           To support the Council in achieving financial efficiencies.

 

(3)       To ensure that the Council’s policies and procedures are followed and that only appropriate payments are made.
