Minutes of a meeting held on 25th March, 2015.

RESOLVED - T H A T the minutes of the meeting held on 2nd March, 2015 be approved as a correct record.





No declarations were received.





The Committee was provided with a report to update them in relation to the progress made with the marketing of the former Southerndown Care Home. 


Since the last report in relation to the former Southerndown Care Home was received by the Committee on the 15th December, 2014, officers had instructed the Councils Property Section to obtain Site Surveys which had now been received.  A revised Planning Statement accounting for the demolition consent had also been received.  Agents had prepared the sales particulars and tender documents had been provided to the agents.


An information pack had been provided to the agent for distribution to interested parties.


Marketing of the building was formally launched on the 20th March 2015 with a tender deadline of 12 Noon Friday 1st May 2015.  Block viewings would be arranged by the agent over the coming weeks to accommodate groups of interested parties wishing to inspect the property. A further report would be presented to the Committee with the results of the Marketing exercise following receipt of the bids.


Since the last report to the Committee there had been further unlawful access to the property which resulted in the Police attending the site.  It appeared that access was gained via a ladder to the first floor level and onto the roof area where it appeared that the trespassers were looking for lead.  It was assumed that any lead that the intruders were able to access had been taken from the building albeit no inspection had taken place due to health and safety concerns.


RESOLVED - T H A T the progress made with the marketing of the building and the tender deadline for bids be noted.


Reason for decision


To have regard to the progress made in relation to the marketing of the former Southerndown Care Home.





RESOLVED - T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.





The Committee received a report to apprise Members of further developments and research undertaken in relation to the above land and its occupation by the Club.


The Committee was provided with an update in relation to the legal research that had been carried out in light of the communication received on this matter, which comprised analysis of current binding case law. The report also set out legal advice that took into account the legal research and current binding case law in relation to this matter.


Following consideration of the report, it was




(1)      T H A T the advice set out in the body of the report concerning the developments since the legal action taken on the 16th January, 2015 be noted.


(2)       T H A T the Estates Department put in place a process to monitor the usage of the land.


Reasons for decisions


(1)       To have regard to the current factual and legal position in relation to the apparent breaches of the lease by the Club.


(2)       To ensure that the land was being used in line with the terms of its agreed Lease.
