EARLY RETIREMENT / REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 26th September, 2017.

 

Present:  Councillor Mrs. R. Nugent-Finn (Chairman); Councillor V.J. Bailey (Vice-Chairman); Councillors Mrs. P. Drake, S.T. Edwards, G. John, Mrs. A. Moore and N.C. Thomas.

 

 

316            MINUTES –

 

RESOLVED – T H A T the minutes of the meeting held on 24th July, 2017 be approved as a correct record.

 

 

317            DECLARATIONS OF INTEREST –

 

No declarations were received.

 

 

318            EXCLUSION OF PRESS AND PUBLIC –

 

RESOLVED – T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.

 

 

319            DETERMINATION OF VOLUNTARY EARLY RETIREMENT ON THE GROUNDS OF REDUNDANCY – J (DEH) (EXEMPT INFORMATION - PARAGRAPHS 13 AND 14) –

 

Consideration was given to an application in respect of redundancy for an employee within the Directorate of Environment and Housing.  Having sought and received clarification of a number of aspects contained within the report the Committee

 

RESOLVED –

 

(1)       T H A T a statutory redundancy payment be approved in respect of J with effect from 13th October, 2017 on the basis of Scheme E in accordance with the recommended benefits as set out in Appendix A to the report and subject to Recommendation (2) below.

 

(2)       T H A T, should suitable alternative employment within the Council be available for J, notice be extended to cover any trial period.  If the trial period proves to be successful and the employee accepts the alternative position, that Recommendation (1) above be revoked together with the redundancy payment.

 

Reasons for decisions

 

(1)       To determine the option for J in accordance with the Council's Early Retirement / Redundancy / Termination policy.

 

(2)       Should the employee be successful in securing suitable alternative employment prior to 13th October, 2017, and providing the trial period is successful, the individual to be retained in the redeployment role which will mean there will then be no need for the redundancy to take effect and so no redundancy payment(s) will be made.

 

 

320             DETERMINATION OF REDUNDANCY / EARLY RETIREMENT – M (HASLM) (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) –

 

Consideration was given to an application for early retirement on the grounds of redundancy in respect of the employee within the Directorate of Social Services..

 

RESOLVED –

 

(1)       T H A T the application for early retirement on the grounds of redundancy  in respect of M be approved on the basis of Scheme E of the Council’s Discretionary Redundancy Policy (as set out at Appendix A to the report) and subject to Recommendation (2) below.

 

(2)       T H A T, should alternative employment within the Council be found for M, the notice be extended to cover any trial period if necessary and Recommendation (1) be revoked together with any redundancy payment should the trial period prove successful.

 

Reasons for decisions

 

(1)       To support the Council in achieving the financial efficiencies and organisational changes necessary to maintain sustainable service delivery.

 

(2)       To support the Council in achieving the financial efficiencies and organisational changes to maintain sustainable service delivery.

 

 

321              APPLICATION FOR FLEXIBLE RETIREMENT – W (HASS) (EXEMPT INFORMATION – PARAGRAPHS 13 AND 14) –

 

Consideration was given to one application for flexible retirement in respect of an employee within the Directorate of Social Services.

 

Having sought clarification on the application and having accepted that the applicant was fully in agreement with the recommendations within the report, the Committee subsequently

 

RESOLVED –

 

(1)       T H A T an extension of flexible retirement for W be approved in accordance with the Council’s policy, subject to no other circumstances arising in the interim whereby the employment would be terminated for a different reason.

 

(2)       T H A T the use of the appropriate Officer Delegated Powers be endorsed to enable W to continue with employment for a further 24 months at a reduced contracted hours from 22 hours to 18.5 hours per week, commencing 13th November, 2017. That the retirement of W from employment with the Council takes place on or before 12th November, 2019 providing no other circumstances arise in the interim whereby the employment were to be terminated for a different reason.

 

Reasons for decisions

 

(1)       To determine the flexible retirement application within the regulations and to allow for eventualities that may not be known at this time.

 

(2)       To achieve the necessary change to the employee's flexible retirement date, to assist service continuity, provide appropriate support to assist the employee's transition to retirement, to contribute to the transition of the Independent Living Fund and enable improved succession planning.  The reduction in hours will also represent a saving to the department without detriment to the team.

 

 

322            DETERMINATION OF REDUNDANCY / EARLY RETIREMENT – E (HOF) (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) –

 

Consideration was given to the proposal for redundancy in respect of E within the Managing Director and Resources Directorate. 

 

RESOLVED –

 

(1)       T H A T a discretionary redundancy payment be approved in respect of E on the basis of Scheme E of the Council’s Discretionary Redundancy Policy (as set out within Appendix A to the report) and within the financial parameters as set out in Appendix B of the report subject to no suitable alternative employment arising prior to 31st December, 2017 and to Recommendation (2) below.

 

(2)       T H A T should alternative employment within the Council be found for E, that the notice be extended to cover any trial period if necessary and Recommendation (1) above be revoked together with any redundancy payment should the trial period(s) prove successful.

 

Reason for decisions

 

(1&2)  To support the Council in achieving financial efficiencies following a review of the Audit Service which has been undertaken this year.
