Information and licence application forms for Portable Toilets
Should you require a Portable Toilet to be paced on the adopted highway then a licence is required under Section 171(5) of the Highways Act 1980 . If you are placing equipment on private land, such as on your own driveway then you will not need a licence from the Council, however your chosen provider may be able to advise you better depending on the proposed location.
It is important to remember that the Council have the right to specify conditions relating to the position of any Portable Toilet on the highway as we need to manage the expectations of the network user and ensure public safety. Please ensure you have read the terms and conditions which better explain key points.
Please note, It is the responsibility of the Portable Toilet operator to ensure that the licence has been applied for and that is has been granted in advance of siting the Portable Toilet.
Licence’s are granted for a one month period only and the current cost of a licence is £125.00. Should the Portable Toilet need to remain for longer than one month, the provider will need to apply for a new licence in the same manner as they did so initially. If the licence is required for less than one month the one-month licence charge will still apply. Portable Toilet licence applications should be submitted least 1 working day before your chosen contractor intends to place it on the adopted highway.
Contractor Registration
Contractors who wish to be considered to trade within the boundaries of the Vale of Glamorgan are required to register as a customer.
Full business details and a copy of your Public Liability Insurance Certificate (£5 million) to be submitted via email to the following email address: skipsscaffolding@valeofglamorgan.gov.uk
How would a contractor apply?
Once registered you can apply online.

Following receipt of your application, we will notify you of the decision to issue the permit either by telephone or via email within 1 working day.
What happens next?
When your contractor submits an application, the location will be assessed to ensure its suitability on the adopted highway network and also ensure no public safety concerns. If your contractors application is approved, they will receive an email confirmation of this and a link shared with them to enable the contractor to make payment for the licence. If officers of the Council have an alternative suggestion or items we need further clarification on then the application will be updated online and your contractor notified via email.
Once the licence has been granted and your contractor sites the equipment, it is vital they adhere to the terms and conditions, and regular checks are made by officers of the Council.
To ensure compliance and ensure the highway network is free of illegal obstructions, officers of the highway maintenance team make frequent checks and where required, we will use powers granted to use as highway authority to issue fines for non compliance against such illegal activity. Please note, should any damage to the highway be incurred then the full costs of a repair will be recovered by Vale of Glamorgan Council.
- If you fail to comply to these Terms and Conditions and all relevant legislation you will be liable to enforcement action which includes Fixed Penalty Notice Part IX of the Highways Act 1980 for Obstruction of a Highway.

FAQ
What if the contractor places the Portable Toilet on my property and the licence applied for is no longer needed.

Can I get a refund?
It is the responsibility of your provider to carefully access your request early on. Any approved applications will only be refunded if a request is made before the start date of the permit then a refund for the appropriate amount may be issued, however If a request is received after the start date of the permit then a refund will not be issued.

If I have a licence for a Portable Toilet in another part of the Vale of Glamorgan, am I covered?
No, the licence is site specific to the address applied for initially.

How long does it take to process?
Officers of the Council require one working day notice from the Portable Toilet contractor to enable us to review and issue a licence, however on occasions it may take more than one working day, for example if there are traffic concerns, or legal parking, loading or disabled bays then a site inspection may be required to negotiate conditions and suggest possible alternate locations for the depositing of the Portable Toilet. In these instances, it may take longer to issue the permit however the Portable Toilet contractor involved will be informed throughout the process.
